So Doctor “ Beth “ Upton is off to pastures new , leaving a large ongoing bill for NHS Fife

Dr Upton is off to Australia it seems, after creating a toxic situation for women in NHS Fife, wonder if Dr Upton is going to be working in “ Gender Services “ down under ?

Its bad wording by both of us.

@Scoffingbiscuits post is about the Scottish legislation which was designed to have a specific hire and training policy.

In effect the service should match its hire policy to the victim sex profile. So the obligation is to match the need to the provision. So same idea as the breast cancer screening service only hire female front line staff

So if say 70% of victims wanted the medic to only be female the service can discriminate and only hire women until they have the 70% and thereafter hire from the total pool of qualified people.

Scottish TRA wanted the legislation to say gender so service would be able to fill the 70% need in provision by the hire of men who claimed to be female.

So if the victim said women only and she did not realise it was a male and more importantly was not informed by anybody in the room he would be sent into court to give evidence on his acts.

The theory being he could not be charged for a sexual assault as it was a medical act carried out after informed consent was obtained and the Act allows his claim to be a woman to stand.

When I was a DC in Hampshire, the primary SARC doctor for one of the major cities was male, and transitioned to become a trans woman who continued to work as the primary doctor.... That was as recent as 2015. I hope he's not still there.

If a SARC is not available and you have to go to A&E you still have the right to ask for a female doctor and wait for an available one.

Yes. Exactly.

And my very point was that Dr Upton considers that he should be classed as a female medical examiner in those circumstances, whereas people in my circumstances rely on Drs having integrity and acceptance that informed consent is important and respecting that a request for a female medic is a request for a biological female medic, not someone like him.

Why do you feel sorry for the Australian women patients? Her medical skills aren't in question and there is no evidence or suggestion that she has ever mistreated any female patient. If you had a collapse and she was the only doctor in sight (like on a plane) I bet you'd be quite happy to put your prejudices aside and have her treat you!

It's very, very worrying that someone with those views is qualified to practise medicine. Either he actually believes it, in which case he is either mentally ill or of very low intelligence, or he is saying it for other reasons, which means he's a manipulative liar. None of those is good.

As I understand it, rape victims do not have the right to be examined by a female medical examiner. They have the right to ask for one, but there is no guarantee that there will be one.

Why are you calling a male doctor, who believes that humans can change sex "her"? Doesn't it alarm you, that any doctor who believes that he can change from a male to a female, should not be trusted and certainly shouldn't be practicing medicine?

In his judgment, the judge said that Upton was a "credible witness".

And the judge turned out to be a non-credible judge.

Absolutely he did. It was so gloriously whacky I saved the quote from the Daily Telegraph:

He did. He lied in court. And it came to light that he doctored his 'contemporaneous notes'.

The 'has quit employment at Fife' is the only confirmed part of the story. The 'going to Australia' part is just speculation by 'an insider' at Fife. However it's not unreasonable speculation as the path to Oz is well trodden by UK medics (I happen to know two myself).

And it's an even more attractive move for someone who can see that the legal proceedings in which they are a central witness are far from over. There is the real possibility of a retrial of Sandie's case plus the additional claims she's started against Searle et al which have barely started. Not to mention the potential for professional disciplinary proceedings.

If it happens it will no doubt be framed as 'forced to flee UK because of transphobia'. 'Didn't fancy facing difficult questions from Ben Cooper and Naomi Cunningham' doesn't sound so good..

I agree that there is hardly anything unusual about a recently qualified doctor moving from the UK to Australia.

I think anyone who suggests that sex is a wibbly wobbly thing that nobody can define should be struck off. It suggests a sexist, privileged dismissal of the reasons that we bother to define sex and a lack the necessary intelligence required to treat patients, but from what I hear of Australia, Dr Upton's presence won't make things much worse.

That’s not always the case. The SARCS here is only available 9am-9pm (at that time it was mon-Fri, but now is 7 days) so I wasn’t sent there, I was dealt with at the hospital as things couldn’t wait until 9am.

I hope Dr Upton never works in medicine again. He maliciously reported a hardworking colleague to his manager, he showed himself willing to ignore a female patient's request for a female doctor, and under cross-examination, by describing himself as a biological woman, he was either lying or displaying a quite remarkable ignorance of biological facts that would shame a five-year old.

True, and they can then refuse the male who wishes to carry out examination. If there isn't a woman available one cannot be spirited up but perhaps they could delay the examination until the next shift come on duty. Very reasonable.

This chap would likely then make a formal complaint about the patients conduct being transphobic against him personally, and make himself the story rather than seek to support the woman in her legal, appropriate choice.
