Interesting discussion about why "but for" causation is not enough. Lawyers, would I be right in thinking that the following is an example of why it's not enough in the case of direct discrimination? Ben and the judges seem to think it's obvious...

A places an order with B. This is the only order B has. B recruits to a role in order to fulfill it, and in the process discriminates against C. But for the order, B would not have recruited - but here A is clearly blameless.

Schadenfreude is an ugly emotion and I try to avoid it on trans issues because it's both unhealthy and objectionable, but my strenuous efforts aren't helped by the screeching dismissal of GC lawsuits by TRAs only to have judgements come back in favor of sex materialism, and the frankly hilarious efforts the GLP to cast their record as anything other than a long string of embarrassing failures and irrelevancies.

It's legally an interesting case because AFAIK there have been no previous cases where any person or organisation has been found to be in breach of Section 111 of EA2010.

Wishing Alison all the luck in the world.

I see this as a win-win.

Obviously if they are guilty of encouraging organisations to break the law, that would be a very appropriate comeuppance.

But if they win and their defence is along the lines of 'we don't expect companies to take any notice of silly old us, we can't be expected to behave legally...', well, I basically chalk that up as a win for us as well.

You know you can preview posts before pressing post? Quite useful. Could help avoid the buttock clenching embarrassment of posting on a thread about a legal appeal whilst proving you don't know what a legal appeal means.
