Why has the updated EHRC guidance not been laid before parliament yet and does anyone have insight on when it will be?

I suspect as Phillipson is in the deputy leader competition. If that had been but a few days later. (updated guidance arrived the same Friday)

That guidance being in place is the thing I and so many places are waiting for. It's urgently needed.

In case it wasn't clear, I was pointing out that if there has been no ministerial approval, there is no 40 days countdown to count.

Again as much of this has been said on the other thread, part of this maybe that Labour thinks once Baroness Falkner has gone MAS will be easier to push around.

Sadly as the instituions who are refusing to follow the interim guidelines have shown, there are also many MPs, many in the majority Party who also dont accept the Supreme court ruling.

The amount of briefing that is going on about how trans people are going to suffer, is an indication of this.

There has been no counter briefing of what has been achieved for women.

And overall I dont think Labour thinks it is a priority for Parliamentary time.

Maybe we will all be crowd funding for another legal challenge.

This time against the Labour Party / the Government for not intergrating the Supreme Court ruling into UK law.

Sadly even if it was, I suspect many will just ignore it.

They did. But we don’t know who they were or what happened next yet

I think the problem with school, particularly Brighton schools is they're going to have a massive amount of egg on their faces. They've been teaching kids that anyone is whatever sex they say they are and can use whichever changing rooms they like. They've possibly been disciplining kids for saying otherwise. They're hoping against hope that something will change, a TRA will get power in government or at the EHRC and find a way to twist it so the guidance can remain sufficiently unclear that they can justify not changing anything.

Cos when they do change it they'll have half the student body that they've successfully trained up in transgenderism in riot because their ideology is now being contradicted, and the other half in riot because teachers are now saying the things the same teachers have bullied them out of saying.

Play stupid games as they say...

I hope they all sue Stonewall.

You have my absolute sympathy and shared fury for your child.

I am looking at the bigger picture and chewing through how to get to where we want to be.
Many of us will be in your town in a couple of weeks
we may not make a difference right away
but ....

I really do appreciate what you are saying.

However.

Literally thousands of organisations have said they will wait for the EHRC. I am not making this up.

Thats too many to take to court. That means rights are being violated now. My main concern being my own daughter.

to the "Supreme" Court they need to give their heads a wobble.

If anybody in the Civil Service thinks that the McCloud case to the European Court will be
(a) soon ..... think ten years
(b) successful .... see how the judge treated their first hearing
they should be sacked for bringing their department into disrepute.

The cases WILL pile up
they WILL go one way
it WILL cost the taxpayer a lot of money that could and should be better spent

And yet - thats exactly what they are doing.

Hasn't this been covered in the existing thread?

EHRC submitted on 5th September, so could have to wait until 15th October.

And as said previously there is the Deputy Leader Contest, the Labour Party Contest and general Labour Party mis-steps.

Although I suspect that although as it is strictly procedural and should just be waved through as it were, the Labour Party is probably concerned that there will be debate from those who object to the ruling, and will try and say there is enough doubt about the ruling that MPs should not approve the EHRC guidance.

ie no chance of slipping it through late on a friday.

And as PP have said, given how many are refusing to acknowledge the status of the interim guidelines, I suspect that for many months ahead, even if approved by Parliament, many groups will still be saying they shouldn't be bound by it. That somehow it isn't valid.

Following ministerial approval, the UK Government must lay the draft code before Parliament for 40 days before it can be brought into force.

Although come to think of it on re-reading this on the EHRC website, have we had the ministerail approval. if not then the 40 days dont start until that has happened.

I just worked it needs to be laid by Wednesday 5 November 2025 in order to come into effect in 2025.

The desperate handwringing and weepy "but it is far too difficult for our piddling little brains to possibly understand until and unless the EHRC write a case study that is specifically tailored to our individual issue; and even then we'll play dumb" is as tiresome as it is embarrassing.

How can so many qualified professional people suddenly forget what a boy or a girl is and need specialist help to know?

Parliament hardly sits between summer and Christmas, so many breaks. And nothing can be laid during a recess, so there is a queue of stuff waiting post conference recess.

Can you run to legal letters and not wait? You'll be waiting, at best, til mid Nov.

Every time I look at what's happening in some schools, I'm filled with horror at what's being inflicted on children by adults. It's incredibly frustrating that the media, many of who have been excellent in exposing so much in the last few years, still studiously ignore the fact that children in many schools repeatedly face unacceptable breaches of safeguarding:
Girls being exposed to potential sex crimes of in decent exposure and voyeurism by being compelled to undress in front of the males.
Girls in the above schools being given the clear message that they are not entitled to boundaries, privacy, safety or dignity if a male insists they're female
The activity of predators in children's charities and pride with schools failing to exercise due diligence and openly welcoming these men into schools.
Schools still insisting that they have the right to transition children in secret from their parents.

All of this still continues yet the media to date haven't exposed any of these schools doing all this in plain sight.

This is a brilliant thread with a committed and frustrated parent - yet his battle continues "under the radar" - as do the efforts of so many parents desperate to safeguard their children in schools.😡

The fact that so many bodies have chosen to break the law since then
is shocking
and I really do not believe that they will all fall into line the day the "guidance" clears the last hurdle.

Oh they won't. They'll continue to break the law until/unless we complain/threaten judicial reviews/take them to court

sadly it's not unusual for public bodies and companies to break the law. They rely on ppl giving up and not forcing the issue

Look, clearly I am on side with this. However there are thousands of schools, hospitals, gyms and more who literally ARE waiting for the guidance to be mandatory. And so - I want to know why TF it has not been laid and when, if ever, it will be. Most orgs are NOT complying yet and will not until this is done.

“We have been clear that service providers, associations and public functions should not wait for the code of practice to be published to make any changes needed to comply with the law. As duty-bearers they must assure themselves of their legal responsibilities in their own specific circumstances and seek independent legal advice where necessary.”

Basically because the EHRC is specific, the Supreme Court is general, and they have said, in writing, they will.

I am aware, that just like all the TIMs, the goalposts can change - the consider themselves biological women because... silly reasons, but they say it anyway

But it's one concrete step forward to forcing change

If they are ignoring the Supreme Court, what makes you think they will actually "obey" the EHRC.

I have read the other thread and am aware of the scale of your battle
BUT
A focus on the ruling by you and utterly ignoring the EHRC might yield results.

There is a way to find out who gave the legal advice (using the transparency data of the council)

It would be work asking whether the school or the council got it
and who from ....

Have a quick look through the link to the other chat, I am DEEP in this. Legal advice is not actually exempt, it can and should be redacted but getting the school to cooperate is near impossible.

Point is - I need the EHRC things settled, now, and I am fed up waiting for the 40 day clock to even start its insane.
