Nurse who challenged trans doctor for using female changing rooms is cleared

An NHS nurse has been cleared of misconduct after challenging a trans doctor who used a female changing room.

Sandie Peggie was accused of misconduct by NHS Fife after questioning the presence of Dr Beth Upton.

Margaret Gribbon, Ms Peggie’s solicitor, said in a statement: “On Tuesday July 14, the evening before the resuming of her tribunal, Sandie Peggie received confirmation from Fife health board that following a disciplinary hearing, none of the gross misconduct allegations against her were upheld.

“This follows a disciplinary hearing on June 25, which considered four gross misconduct allegations: two relating to patient care failures, one of ‘misgendering’ Dr Upton, and one relating to her encounter with Dr Upton in the workplace female-only changing room on Christmas Eve 2023.

“Sandie is relieved and delighted that this 18-month-long internal process has concluded and cleared her of all allegations.”

Assuming this was not a worry about him working in the one area of the hospital which will have violent (screaming spitting hitting) people in on a regular basis? Rather his wife is worried about a smaller female co-worker with a long unblemished work history.

@Twiglets1 You should follow along this week as the ET explore why the senior management incharge of A&E were discussing having PS arrested and prosecuted for not wanting a man in the womens changing room.

And think about the culture of that team what that means when a woman or man requested the provision of same sex health care.

Leading to anomalies between the Herald's text and reported speech/text.

I hadn't come across this info before:

"They took two months off work in March 2024 after learning Ms Peggie was returning to the department. They told the panel they had suffered "daily panic attacks," and that "her wife was concerned about safety at work."

(IIRC Upton said that his wife had suggested he make a formal complaint about Sandie because he was so upset. Maybe she was just sick of him hanging around the house and wanted him to get back to work?)

"I feel people — especially in this country — can be prejudiced towards trans people," they said.

(Especially in Scotland?? So much for all Sturgeon's best efforts, the steamrollering through of the Gender Reform Act, all the rabid TRAs in Holyrood, "Decapitate TERFs" placards, etc. That Scotland?? 😂 )

"I was conscious of the potential for this situation to become so much bigger, which it has subsequently done.

They said there had "been leaked pre-transition photos of her and harassment of her and her family, all of which has been very distressing."

They said journalists had turned up at their door and harassed them and others around them.

(So journalists doing their job? Maybe that is why The Herald is running with this story in this way? 🤔 )

Ms Peggie's legal team sought an order for Dr Upton's phone to be inspected by forensic expert Jim Borwick. However, this was rejected by the tribunal.

They wanted to discover the date and time the notes were created and when they were edited.

Mr Borwick is due to give evidence on Tuesday.

(Dr Kate Searle is also due to give evidence and be cross-examined at the tribunal on Tuesday. Tuesday is shaping up to be a day not to be missed!)

Asked why she told colleagues before Christmas Eve that she would speak to Dr Upton directly, Ms Peggie said: "No one appeared willing to speak to Beth on behalf of myself or my colleagues.

"I hope that by speaking to him personally, he might be able to realise he was making us feel uncomfortable by changing in a female changing area, and the reason why, in the hope he would understand and change elsewhere."

She said she entered the changing room to change her trousers, which were soiled due to menstruation, and that the situation made her feel "embarrassed."
Asked whether her feelings contributed to the interaction, she said: "Yes."

Asked if she had discussed the incident with a supervisor, she replied: "I wasn't upset I was menstruating.

"I was upset because my dignity as a woman was being violated because I was being forced to deal with the situation with a male being present in the female changing room at a time when I felt vulnerable and in dire need of privacy and a single-sex space.

"I didn't feel comfortable speaking to the staff I was working with, especially as it was a personal and embarrassing matter. I was keen to go home, especially as it's Christmas Day, and discuss my upset with my husband and my family."
She said the incident lasted just two minutes and that she hoped the conversation might help Dr Upton understand.

Asked why she didn’t report the matter, Ms Peggie said: "I was hopeful that Beth would accept my concerns and the reasons why I felt uncomfortable.

"I tried to give him an example so he could appreciate the severity of the situation. I told them I had a difficult history with men."

"I didn’t think it was necessary to speak to anyone, because I was hoping, on reflection, Beth would understand."

She said she was "upset that the interaction did not seem to have had any influence on the way Beth felt, and I realised from his reaction that he did not seem to care about the stress he was causing me."

"I was left shaken following his response. It was on my mind throughout the shift, but I did not want it to impact my work."

Seems like you have to take two months off work to recover for NHS Fife to take your distress seriously. Though I do doubt whether NHS Fife would have been so sympathetic and accommodating if female nurse or a bog‑standard bloke had taken two months off work after an "upsetting" conversation lasting less than two minutes. Enraging to think what Sandie has been put through by this entitled prick and his gruesome female enablers!

As pp have said, he has admitted that he would lie to vulnerable women in order to examine them intimately. It seems that his gratification is more important than women's right to dignity and privacy.
This is very disturbing behaviour and this man should not have access to women, nor should he be in a position of power.
The senior people in the Trust should not have facilitated his behaviour.
The NHS always punishes whistle blowers.

As pp have said, he has admitted that he would lie to vulnerable women in order to examine them intimately. It seems that his gratification is more important than women's right to dignity and privacy.

I once interviewed a Very Ugly Short Stout Woman Wearing a Wig for a job. I honestly didn't twig but my boss did.

He basically self-excluded by banging on about how he would work above and beyond the Job Description when the advert clearly stated that there were strict boundaries to the job and no opportunities to expand the role.

Can't help but see a pattern now I am more aware.

@Twiglets1 At the start of this case I felt the same way as you. I still feel that both people were badly failed by more senior staff. However unlike you when I heard about Upton's recording from the start of every imagined slight I realised that he was looking for a way to make trouble.

At a time when resident doctors are struggling to find work I'm afraid he deserves to be out of a job.

He wont be struck off, at most he'll be suspended and told to go away and reflect, but no sensible health authority should employ him.

100% someone who is doing that to colleagues is unemployable

He genuinely sees himself as female so that has to be taken into account re examining women in his professional capacity as a doctor.

If that’s the case he is deluded and needs serious mental health support and should not be doing a job that requires supporting people (especially women) when they are often at their most vulnerable.

and his employers are at fault for playing along with that delusion

A woman who IDs as a man was recently refused a GRC because she was trying to get pregnant - one of the requirements of getting a GRC is committing to live your life in your new 'gender', and it was felt that committing yourself to living your life as a man and trying to get pregnant was totally WTF??
