The NMC is going through reform if its processes. However, from various reports it is still a remarkably skewed witch hunt at times.

I believe that if they refuse to accept a settlement offer, go to court and win but are awarded less than they were offered to settle, they are liable for all costs, which can easily exceed the award and be ruinous, although it does get important legal rulings and precedents set.

This is where JKR's fund may come in useful...

Unlikely in ET cases. Costs are seldom awarded

Now I wonder who could possibly have made those complaints, someone and his little cohort who threatened to make a Citizen's Arrest on Naomi Cunningham and a Judge perchance?

Well if it is them they’re bliddy idiots. Massive own goal.

Just read on X that the NMC have had four complaints against the nurses and are investigating them. Found this update https://christianconcern.com/ccpressreleases/darlington-nurses-reported-to-nursing-and-midwifery-council-for-speaking-out-over-nhs-policy-that-forces-them-to-undress-in-front-of-a-man/

I firmly believe that people have the right to complain and it should be taken seriously and investigated. However, in this case I hope the NMC find no case to answer.

The nurses don't have to accept a settlement offer, no. But that's not the only way for the NHS trust to end it. They can offer no defence (essentially plead guilty).

That avoids all the days in court and the publicity for the witnesses. It goes straight to a panel decision based on the bundle.

Theeyeballsinthesky · 08/10/2025 08:51

Is it only up to them though? If the Nurses don't want to settle I assume they don't have to?

You’d think so wouldn’t you….?
But I fear we are into “last Japanese soldier” territory…

After all of the recent cases I wonder if the trust will just concede? It would probably be cheaper and create less press if they simply held their hands up and let the judge decide what compensation is due?

The surgery part is horrifying.

Treaclewell · 07/10/2025 20:23

I haven't read all yet. I am steaming over the operation story. Didn't her consultant have any input? Words actually fail me. Who cares how this self identified non-human feels? Apart from the trust that is. Thank goodness I don't depend on them for treatment.

@PersonIrresponsible

It's [email protected].

Hutchison & others v County Durham and Darlington NHS Trust
2501192/2024 Public Access Request

I suggest putting the whole of the above in the subject line for their ease of reference.

I asked for remote access as a member of public and set out the name and email address I would use. I got an immediate reply simply saying that links would be sent by email one working day before the hearing. No mention of any limit on numbers or log in requirements.

PersonIrresponsible · 07/10/2025 18:05

Does anyone's have the tribunal info/email template so I can request to observe?

Mucho appreciated if so.

I think the Defra SEEN network chairs were not allowed to do any SEEN-related activity in their working hours. Unlike the trans network a:gender who allegedly had a paid position…

I saw a presentation on YouTube by an LGBTQ network chair in a Midlands NHS Trust. They explained that this was a sort of a promotion taking on this role. It came with a set amount of time each week to dedicate to LGBTQ network tasks. He set about integrating the NHS Rainbow Badges scheme into his trust. He did no consultation with any women or the women’s network as he systematically adjusted all the policies to be unlawful Gender Self ID basis. So there was definitely an internal staff cost (hourly rate) dedicated to this work but I’m not sure if the chair also got a pay rise to do it. The chap certainly thought of his title as a promotion tho.

I am not sure whether it would be better to win to reinforce the right for SEEN to exist within DEFRA or to lose on the basis that no staff network should exist and all networks, including LGBT+ ones, must immediately shut down.

Or just permit them to exist, like member groups/ clubs, but NOT getting any budget or having the status of a stakeholder body, which is how they seem to be being treated currently (apart from the SEEN ones, which haven't had any budget as far as I can see, and whose members have been witch-hunted - see the new report https://sex-matters.org/posts/updates/new-report-on-everyday-cancellation-in-publishing/#:~:text=Has%20publishing%20has%20become%20a,is%20binary%2C%20immutable%20and%20important.)

Durham and Darlington trust is my local trust. I'd much rather they focussed on patient care than political handwringing and bloody calendars but hey, I am just a woman waiting for a medical appointment to fix a health issue. What do I know!

A spokesperson for County Durham and Darlington NHS Foundation Trust said: “The calendar was developed and shared internally, during June which is nationally recognised as Pride Month, as part of the work led by our LGBTQ+ staff network, using time allocated through our staff network group framework.

People campaigned hard for rights to engage in union activity at work, and now networks are taking time off for "networks", which I don't believe are legally protected in the same way as actual unions.

If staff networks want recognition and protection, there should be a more robust framework for them, not just the entirely informal status which ranges from the above... to situations like SEEN in the Civil Service: Elspeth Duemmer-Wrigley, a chair of a SEEN (Sex Equality and Equity Network) network) was accused of harrassment in a DEFRA-affiliated org. Although the tribunal case against her was dropped, "The individual works for another organisation linked to Defra and is still suing the government department for allowing the network to exist." (according to The Times this spring)

Parts of the NHS clearly has too much funding if there is time and money to be spent on this. The NHS needs to get back to basics and to start addressing waiting lists.
