Employment Tribunal Case to Protect Single-Sex Facilities at Work

Dear Mumsnet Members,

I have issued an employment tribunal complaint against NHS England to protect single-sex facilities at work.

A preliminary hearing will be held in early October 2024. I would be very grateful for some urgent gardening support at CrowdJustice. I won't add a link here as it is against Mumsnet rules.

It would be interesting to hear other people's views on legislation around single-sex facilities at WORK. However, I won't be commenting much on this public forum whilst the case is on-going.

Yours faithfully,
Faye Russell-Caldicott / FayeRC

I hope you win 100% and teach them and all the others the lesson of their lives, so that no one else has to endure this nightmare.

Good luck, Faye! Flowers

All crossables crossed, @FayeRC !

KnottyAuty · Yesterday 19:18

Fingers crossed for you @FayeRC

Kirschcherries · Yesterday 17:54

I hope you get the aggravated and exemplary damages. I couldn’t believe TT that NHSE are still painting GC beliefs as unacceptable.

FayeRC · Yesterday 16:35

Hi all,

Remedies hearing is now over - I've asked for both aggravated and exemplary damages, which is quite rare.

Tribunal Tweets 2 (they have two accounts) reported on the cross examination and proceedings, if you want to have a read.

We will have a reserved judgement in 3-4 weeks' time.

Thank you Faye, as @IwantToRetire posters commented, I too follow these threads and contribute to the gardening where I can. It should not be this way. Women have the right to dignity and privacy. Your tribunal and other tribunal’s are giving me the strength I need to push forward with my ET although for a different matter. I would not be surprised if my questions about the legality of name changes on official and legal documents with no deed poll. They are children will be used against me as a way of suggesting I was a bad employee. I know that I am legally protected thanks to women like you and Sandy, Darlington Nurses fighting back on our behalf.

KnottyAuty · 26/07/2026 23:14

great news! good luck for the next steps

SidewaysOtter · 26/07/2026 21:51

Well done Faye!

Deanefan · 26/07/2026 21:35

Well done Faye that is a brilliant update

IwantToRetire · 26/07/2026 21:28

Thank you from me as well. I have been following this thread, but realise without commenting it can seem that fewer than actually are, are wanting to support.

Another one saying thank you Faye. Taking on the toxic monolith that is the NHS and compelling them to weed out their predatory policies is so important Flowers

PachacutisBadAuntie · 26/07/2026 20:07

Well done Faye, and thank you so much for fighting - for all of us 💐

Ereshkigalangcleg · 26/07/2026 16:56

Fantastic, very well done!

AmaryllisNightAndDay · 26/07/2026 16:53

I'm not NHS staff but like all of us I'm a future / potential NHS patient. Sorting out staff policies moves the NHS closer to sorting out their policies for patients as well. So thanks again!

Kirschcherries · 26/07/2026 16:47

Good luck with the remedy hearing. Thank you for doing this.

Earlier this week, NHS England announced an interim policy change that all staff must use facilities as per their biological sex or single-person units. They also removed the policy section 4.11. which allowed TIMs to use female facilities. My remedy hearing will be held on 6-7th August.

Well that sounds like good news for NHS policy. Well done and thank you for helping to make the change happen. And good luck for your remedy hearing.

Will be visitng your allotment. Flowers

Good luck Faye. And thank you !

anyolddinosaur · 26/07/2026 07:21

If the remedies hearing doesnt give you enough to cover your legal costs please ask for help here.

AssignedTERFatbirth · 26/07/2026 02:29

Brilliant news - well done Faye.

BridgetYourFortyDaysAreUp · 25/07/2026 22:50

@FayeRC Thanks for the update - good luck in August!

True, but not great for @FayeRC to have to go through all that additional stress in the meantime

Agreed.
The ideal scenario in future cases is for the GC side to win, the TRA side to appeal, and the GC side to win again.

StandingDeskDisco · 06/06/2026 10:40

It would be good if they did, and lost, because then the judgement would be binding on all lower courts / tribunals.

I hope they’re not thinking of appealing the ruling!
