The situation leading to this alleged crime should never have been allowed to happen. The trial is of the two men, but there seems to be gross negligence by the system - a five foot female was not likely to be safe regardless of ‘identity’.

She didn’t have capacity. The state has stepped in to protect her from herself. That’s what psychiatric wards are for. Only they didn’t protect her. Even though she clearly needed their help or she wouldn’t be an inpatient. Nice victim blaming though.

Exactly. The state was her guardian and is responsible to keep all patients safe.
I guarantee that other patients will have been raped there too. She won’t have been the first or last. They just don’t care. Psychiatric wards and prisons are human trash dumps.

Male rape in a prison or sectioned setting is not unusual, This woman put herself in this situation. If she wasn’t pretending to be a guy, she’d never have been raped.

She should not have been put in that place, whatever she ‘identified’ as. The doctors etc knew she was female.

and if the men ‘lacked capacity’, why are they on trial for the alleged crime?

Awful. She didn’t put herself into being so mentally ill she thought she was a man. No one chooses to be ill. She was so ill, she was committed to a psychiatric ward. Being committed means you lose your civil rights. You are detained and the state decides everything for you. Where they are going to incarcerate you. When you sleep. What you eat. Whether they feel like injecting you with tranquiliser until you pass out. When you can go outside. When you can shower or use the toilet. What healthcare you are given. There is no consent asked or needed.

She was put into the situation by the state. They are responsible and the male patients may have partial responsibility depending on how aware they were/or mentally ill they were when they raped her. A good psychiatric ward will have enough staff to keep the violent patients separate from the vulnerable ones.

The mixed sex ward I was on, I wasn’t inpatient, I was inspecting it.

Although this situation is complicated by mental illness, it does tend to show that we really can't identify out of the dangers of being women. Seems as if men CAN tell someone's sex when they want to.

I know it's not the main point of this horrific incident, but that article is an absolute mess of pronouns. It really illustrates the confusion and obfuscation that wrong pronouns cause. "He has female anatomy" ???
In such cases clarity is vitally important.
