Clearly private spaces for women are considered a necessity by many due to a propensity for male sexual violence. Given this threat is much greater by orders of magnitude in the work place as opposed to public bathrooms, isn't it inconsistent not to demand private spaces there as well?

Coming back to this article, as I said before it is four years out of date and predates the Supreme Court judgment. It is also only a High Court judgment, so it has now been conclusively overruled by a superior court and High Court judges would no longer have the ability to reach this decision.

With the benefit of the Supreme Court judgment, it is clear that this decision is wronger than a wrong thing what used to be professor of being wrong at Oxford University.

"It is not possible to argue that the defendant should have excluded from women's prisons all transgender women."

❌ WRONG. The law actually requires that they are excluded from women's prisons. Because they are men.

"Schedule 3 is discretionary."

❌ WRONG. A women's prison is a female only space therefore correctly applying the single sex exemption is not optional.

But even without the benefit of the legal clarity that we now have, the judges' findings were shocking.

They acknowledge that housing trans identifying male prisoners in women's prisons increases the risk of harm to female inmates. They acknowledge that female inmates will suffer "fear and anxiety" as a result of being incarcerated with trans identifying male prisoners. They claim that existing policies should mitigate this despite the fact that the claimant was actually sexually assaulted by a trans identifying male inmate and so the existing policies clearly failed to protect her. They knew that in a three year period at least seven sexual assaults were committed by trans identifying male prisoners in women's prisons, meaning that between 1 in 5 (if all the assaults were committed by different people) and 1 in 20 (if all the assaults were committed by the same person) of the trans identifying males housed in women's prisons actually went on to sexually assault a female inmate. And then these two privileged white male judges went on to dismiss all of that on the grounds that housing these male criminals in the men's prisons where they belong "would be to ignore, impermissibly, the rights of transgender women to live in their chosen gender".

Let's be very clear about this.

There is no right for trans people to be in spaces for members of the opposite sex. Such a right does not exist and never has. For a time those people were granted the special privilege of being allowed in spaces for members of the opposite sex, but that privilege came at the expense of the actual rights of the opposite sex and never should have been granted, even to nice, law abiding trans people.

But when it comes to convicted criminals, well, they are denied many rights which the rest of us enjoy. They have no right to vote. They have no right to walk around freely. They have no right to decide what to wear or eat that day. They forfeited those rights when they decided to commit a serious crime, incurring a custodial sentence.

Like actual fucking fuck do we need to give even the slightest, shiniest shit about the gender identities of convicted criminals. For actual fucking fuck's sake.

If being housed in a men's prison would be so very intolerable for you because you believe you are a woman despite all the evidence to the contrary, the solution is actually very simple. Refrain from sticking your penis into unconsenting women (or any other criminal activities) and then you won't get sent to any kind of prison.

Its wrong because the State is in control of the women in the prison.

The State owes the highest duty of care to the persons who by circumstance can not enforce their rights or freely access the courts to seek redress.

Being subjected to sexual abuse is unlawful as is aiding and abetting that type of criminal act

The State has the similar control over prisioners as a parent with a 2 year old child (control over location, food, healthcare meeting people etc.).

What would the State do if parent said that they would allow their child to be placed in a situation where the child is forced to provide companionship to a male rapist?

What would the State do if parent said that they would allow their child to be placed in a situation where the child is more likely to be sexually assaulted?

We can decide the answer to that quickly and correctly with minimun thought.

Yet when it comes to a sub-class of men in prison the judges benchmark is set at "its ok to harm women"

The judge said N+1 is acceptable.

That JR that was posted about the prisons was deeply troubling. And it should never have been left up to a female prisoner to bring that court action. And who the fuck would appeal the decision to go through all of that.

I've ceased being surprised about wanky men who come on here with ridiculous arguments about women's personalities, and so what if women get raped. And then fondly imagining that the ladies loos must be just like the men's, because they have absolutely no experience of female biology connected to periods, breastfeeding, miscarriages and pregnancy.

What's mildly surprising is that he kept it up for 10 pages.

But then I remembered that some men like nothing more than mummy's attention, even when, or more likely especially when, they're talking absolute drivel.

And obviously, it's been highly entertaining watching the women rinse this poster and his arguments, over, and over.

Did we ever get an answer as to how many women are worth sacrificing? Or indeed what specific personality trait defines them?

Your'e confusing two different issues here.

No one claimed trans women like shopping ergo they belong in women's bathrooms. It's been stated repeatedly that trans women require the use of women’s bathrooms for safety. As a separate question a poster obsessively demanded to to know what commonalities CIS women & trans women had so I answered that question.

@Howseitgoin No, trans women really DON’T need to use women toilets for safety. They are biological males. If they do not fancy using men’s toilets for whatever reason, there are plenty of unisex toilets available as you mentioned earlier.
You also said that single sex spaces are a Victorian concept and mixed sex spaces are a way forward. So why are you insisting now that transwomen need access to these outdated spaces?
You say that transwomen’s personalities are the same as women’s. Why do they need other women’s presence to feel female?
I am a woman and feel a woman regardless whether I am in a company of women or men. I feel a woman in a single sex toilet and in a unisex one as well. If I was forced by someone to use men’s toilet, I would still feel a woman.
If transwomen are like me, why can’t they just feel feminine in unisex toilets?

That’s not been my experience. Mainly on the autism spectrum and exhibiting at least some degree of black and white thinking, and aggressive behaviour if you don’t comply with their belief. And some frankly fetishistic exhibitionism in some. I have not met one that I thought had a “female soul”.

You miss the point about gender stereotypes, it seems.

Yes, lots of women behave in accordance with gender stereotypes. And many more are expected so to do. (That's what "stereotype" means.) But some (many) of these stereotypes are deleterious to women. I might want my granddaughter to be a doctor, not a nurse, for instance, for her benefit and that of wider society.

Or I might be pleased if a child, asked to draw a scientist, drew a woman in a dress (yes, another stereotype, I know ...) rather than a man in a white coat.

OK, you get the point? - Some gendered behaviours, expectations, etc., may be bad for women. Attempts to reinforce such stereotypical behaviours and expectations, then, as connected with womanhood, is a particular aspect of a form of sexism: such attempts are anti-women.

However, it's precisely this you advocate in your posts about trans-identified men being considered womanly because of their attempts to copy behaviours associated with women.

Can you see how such behaviour - as well as your advocacy - is, indeed, basically and fundamentally sexist in its treatment of gender stereotypes? - Think about it, anyway.

@Howseitgoin I have been researching toilet safety for years. I agree Google is useful. Toilet crime is so common it doesn’t usually reach nationals. Google your local newspaper and search ‘toilet’ on its website.
It will be assaults on women, voyeurism by men, and deaths of men and women (often drug addicts and heart attacks). Every time.

Just coming back to this.

This OP has determinedly ignored the harms to female people by the inclusion of some male people because the OP narrows these 'harms' to physical harm.

Many of us on this thread, and another thread have told this OP that 'harm' is not limited to physical harm. There are many harms that will never be captured as data, those harms will never be recorded or reported. That does not make those harms to female people any less important nor does it make those harms not able to considered.

The outcome of those harms however, can be drawn from the responses to direct questions such as 'do you agree that some male people should be able to access female single sex spaces'. And for that we have the answer that I will post in a minute.

However, it is important to keep reminding the OP that harm is not limited to physical harm at all.

Some stats

One of the men who have a Irish GRC.
One of three who were sent to the womens prison system.
Unlike in the UK men are not allowed to be placed in the Womens Prison system
Zero women who have been issued with a GRC have been placed in the Mens Prison system (yet).

Hes 1 of 3 in sent to prison
Thats from a maximim population of 1000 (male and females) who have been given a GRC

He is so dangerous that the risk assessment for the childrens unit banned women from managing him or around him and the staffing was a minimum of 5 male officers.

He went to court to prove that wanting to stab and rape ones mother did not mean one was insane.

He is one of 56 (or more due to over crowding) inmates in Limerick Womens prison

Exactly.

Incarcerated women actually ARE among the most vulnerable people in society, and unlike the rest of us, do not even have the option to self exclude from a female only space if a man is present, because they are literally locked up in that space with him.

Those judges completely disregarded those women's actual, real, fundamental human rights, including Article 3 (prohibition of inhumane or degrading treatment or punishment), Article 5 (right to security), Articles 9 and 10 (right to freedom of thought and conscience and freedom of expression, in this case the right not to agree that the male sex offender they are being forced to shower next to is a woman) and Article 14 (prohibition of discrimination) in the European Convention of Human Rights, in deference to the completely imaginary, non-existent "human right" of male sex offenders to serve their prison sentences in a female prison on the grounds that being with locked up with other male criminals is inconsistent with their "female gender identity" (but using their penis to rape a woman is not).

Fuck knows how the judges arrived at that conclusion but they are clearly unfit to sit in the High Court.

Thank goodness things have moved on significantly since 2021.

Therefore, it is irrelevant what personalities transwomen have. They should use the toilets correct for their sex.
