NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #41

nauticant · 24/07/2025 14:08

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Anne Hamilton says she has worked for NHS Fife since 2006. She is a HR advisor.
She has only met Dr Upton and Ms Peggie once during conduct hearings.

The row over pronouns has undoubtedly been the standout from the evidence today so far.
Here is the write up from Political Editor Andrew Learmonth: Sandie Peggie treated liked 'heretic' says legal team

Lawyer’s use of male pronouns for transgender doctor sparks tribunal row

Tribunal hears accusations of misgendering and 'heresy' as lawyers clash over use of male pronouns for Dr Beth Upton in NHS Fife employment case.

Pronoun gate also shows I think the difficulty some of the witnesses have irrespective of NC own use. Even IB had trouble referring to Dr. Upton as "she" despite supposed allyship.

Appalonia · 24/07/2025 15:03

Dr Upton is a transwoman who has a right to use the changing room, she said. Er, NO

These organisations need training in what the actual law is, pronto!

Next witness taking the oath

When I read the judge asking 'Will you take an oath'? I hear 'Ye'll have had yer tea'

rebmacesrevda · 24/07/2025 15:06

It's Anne from HR 😁

This is the takeaway that is quite difficult to parse from TT and Herald etc but is where NC went with DU in first part of ET and is now confirmed by AG

Am I right in saying that this should have been an exact transcript of the recording?! Utterly shocking that she would have allowed DU to manipulate the record of the meeting like this!!

I have to retire from the field. Well that had its ups and downs! I'll read back the bits I missed on the threeds (like all of it)

Thank you for your service sir! 👏

This witness will go over to tomorrow as JR said an hour in Chief and half hour in cross.

<sigh>

They are not going to finish all the witnesses in time. Maybe they will postpone submissions to another date. Which other one did that recently?

Cookiepuss · 24/07/2025 15:08

P1 - what did you do with names given
Fifer : pit them in twa columns. Guid Guy, and Wank. Standard Procedure.

@BezMills laughed so loud at this that I woke the cat up who was fast asleep under my desk.

My DH has asked how JR can say "DU is not a man" with a straight face - said it's obvious to anyone with eyes in their head that DU is a man.

As this goes, for me this is just time-consuming admin. There are loads of people out there who are putting a great deal on the line in this fight. If you want to make a show of thanks, it should go to those people. (This isn't meant to sound arse-y.)

I was thinking the same, it shows how difficult it is to use wrong sex pronouns and how disruptive they are but also how petty and pathetic the people who insist on them are.

It sounds like its revealing how they are being used as a tool to try to intimidate and distress people, too.

MarieDeGournay · 24/07/2025 14:54

Ms Glancey said she "absolutely respects" Ms Peggie's gender critical beliefs, but it is absolutely not okay to question Dr Upton in the way she did.

'in the way she did' being 'in the way that DrU said she did'😠

But she admitted that it would be fine to challenge "Pete" using the female changing room. 🤔

Wee cuppa tea and some oath biscuits would go down nicely.

The Pool tournament ones; though I think they knew that the SC judgment was imminent?

Banana oath pancakes

PlasticAcrobat · 24/07/2025 15:11

'Exorcism' seems to be still popping up. Is the scary stenography machine (whose keys mean what it wants them to mean) exercising a supernatural influence on other keyboards? Should it be exercised/exorcised?

ArabellaScott · 24/07/2025 15:11

Don't start me on oathcakes, I'm on a diet.

So the only difference is Dr U uses the name "Beth", wears female clothes (though mostly scrubs probably) and says he is a woman.

If Pete says while in CR that he is henceforth "Pam", can he still be asked to leave?

ArabellaScott · 24/07/2025 15:13
the exorcist father merrin GIF

Exorcism may relate to when Mrs Doyle ratchets up the insistence on a cuppa tea and some oathcakes.

MarieDeGournay · 24/07/2025 15:13

JR plodding going through dates of what happened when, which also isn't going to look good for her side - in one leap we've gone from March to Nov with nothing much achieved. I think 'urgency' was announced in.. April, was it?

No, because magic words.

anyolddinosaur · 24/07/2025 15:14

Naomi went there with a witness, Isla I think. Pete could be questioned up to the time he said he was a woman.

MarieDeGournay · 24/07/2025 15:15

JR.... SP did not escalate to head of nursing or grievance

is there evidence she did escalate, and will NC produce it?
