NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #40

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

You can usually take early retirement from 55 and draw from your work pension but you won’t get your state pension until the age set by government. Current generation is set for 67 before you can access state pension.

NHS Pension has different sections, depending on when you joined. I can get some of mine at 60 (1995 section), and the rest when I'm 68 (my state pension age). Assuming SP joined prior to 1995, I think she'd have a different arrangement. There were special pension classes for nurses but I don't know the details.

I hear JR is going to the argue the Supreme Court clarification doesn’t cover work places. So one side will lose on the point of whether Fife’s “policy” was legal and whether Dr U should ever have been there in the first place.
Im pretty sure if Sandie loses on that point she will appeal it. Do we think Fife or DU will appeal if they lose on that point?

I dont think they will they have been embarrassed enough however i do think Dr U may try to sue Fife for something he gives me the vibe that the trans must win on something and sadly i think they will probably settle 🤦‍♀️

Somebody on the last thread, apologies, I can't remember who, said they thought Kate Searle got off lightly. I agreed and then started thinking about why.

I realised NC didn't spend much (maybe even any?) time on those letters Maya put on TwiX about the fact Kate had found Sandie guilty from the moment she opened the emails and found out something had happened on Xmas Eve. Do you think that's because she thinks that fact is so obvious she didn't have any questions? I'd have liked her to have been forced to admit her blatant partiality at the tribunal!

Fact was so obvious. When asked why she chased down the HCA she said something like I wanted to check if she could support Beth’s version. Not to see if she could provide evidence. A fix is a a fix is a fix.

Also previous day NC her through Sandies position and asked if she ever considered that. It was clear not.

This is one reason why terfs tend to be older. There is nothing like motherhood, and then the young kids/older parents stage of life, to make you realise a) how stark the biological difference is and b) what the actual expected female role in society is and how few male people who "live as women" are actually doing it. Shopping, cooking, ferrying kids to swimming and Brownies, taking the dog to the vet, keeping on top of birthdays and school holidays, pulling a World Book Day costume out of thin air the night before and so on usually while working as well.

It's not because we are angry, wizened old hags. That's just a bonus.

I also think (from a young terf perspective) that when you're very young, you're actually not aware of sexism for the most part. Looking back I can see I experienced childhood differently to boys, but at the time I really did not feel like I experienced misogyny, even in secondary school. So I was aware of it, and knew it existed as a concept but as I had no experience of it I channelled all my activism power as a teen into TWAW. Then when I became 18 and started getting male attention and also experiencing some misogyny, I was too caught up in what to do with that attention and became VERY caught up in capturing the male gaze at any cost. this went hand in hand with TWAW because as I believed that my value was in my looks, it made sense that other feminine-presenting people were in the exact same boat as me. and besides, being a woman was fun, I felt wanted! Some years later about age 23 I realised male attraction was not all it cracked up to be, being objectified isn't the same as being valued, and the penny dropped. I think it takes some young women a lot longer for the penny to drop as they're battling the push-pull relationship with the male gaze for much longer, but having a TiM older sibling who grew up making misogynistic jokes and then suddenly became "more woman than me" probs helped me along in my journey to understanding. Sorry for the ramble lol! I just think some young women are too enthralled with being in the spotlight of male attention it's difficult for them to see reality clearly sometimes. Did that make ANY sense?

Not sure if earlier posters got responses, but just wanted to politely disagree with those who suggest KS is scared of Upton or the consequences of going against gender supremacy. She seems like a true believer to me (as do many of the other Fife witnesses). I don’t know whether she genuinely believes she is being kind, but she certainly has a huge drive to be seen as kind. I think a combination of low empathy, high ego, a desire for control & to be right, and apparently low honesty have created a massive blind spot when it comes to her own actions. I could be wrong and I’m no expert in human behaviour, but I have been watching proceedings and I can’t make fear fit with the responses I saw.

Individuals involved may have various flaws and failings.

They have only been enabled and encouraged by the workplace culture, though. Which has been fostered by people higher up. One could also ultimately look to the Scotgov, Health Secretary, for example.

Does that mean the IT expert is a Fife witness? I've been wondering about that. I knew defence witnesses came second but I've been wondering how an IT expert in this case could be in Fife's favour.

Fife have definitely called their own IT person, probably to talk about how they searched for documents for disclosure. I haven't heard anything to suggest he witnessed any of the events in question or was involved in any way, so I can't think of any other reason he would be called.

I have seen reports that the mobile phone forensics expert is being called by Fife. If so, I would imagine they will try to highlight any of his findings that back up their case.

Perfect sense. Many of us have experienced much the same process. We are hoodwinked into offering our sexual availability as young women. Then realise later on that most if it was a con. And our mothers and grandmothers were right.

Tragedy of womanhood, I think. Part of patriarchy is calling older women 'hags', and othering and excluding those who would be able to help younger women.

Probably why the relentless TRA accusations of us as 'old ', especially coming from men who are older than I am and want to claim they are more secually attractive. They are desperately trying to buy into a system that many women here are very aware of as a risky, damaging con.

If a woman was admitted to A&E in the last stages of labour, would Dr K Searle have to deliver the baby?

Are there ever any circumstances in which KS as an emergency physician would have to deliver an infant?

If so, would she be required to ascertain and record the child's sex?
