Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Thinking about the Sandie / Rihanna thing, it seems to me they have a fine relationship that Rihanna doesn't want to spoil by speaking out against Sandie.

I don't quite understand what you mean? The respondents (Fife and DU) are trying to show that the disciplinary process against SP was carried out fairly

So HR is an obvious witness for them

But HR are aware that Sandie's suspension was not appropriate from the off. Their advice was not followed if I understand correctly.

Remember people higher up the food chain will be wanting to protect their backside too.

Oh we rely on HR, they said not to suspended Sandie
But other managers decided to do it anyway and nobody told the chief who's now got the phone book down their trousers 👖 protecting their ass from a kicking!

It seems unlikely that NHSF's email policy is to delete after 30 days.

If it is, then is it a policy the board would have to sign off?

Having users decide what is relevant / not relevant, what to keep and discard, sounds very lax. How does a user know what will be important in six weeks or six months.

FWIW my work emails are received by a company server and are the property of the company. They are not my property to decide to delete

If a user claims that they regularly use 'Re:' to start emails then it should be easy enough to produce 4 or 5 more contemporaneous message chains that start this way

Am I right in saying that Naomi Cunningham said that Sandie never mentioned Isla Bryson but then Jane Russell found a document which said that she did, and it was read out. So it looked like a bit of an own goal for Naomi.
But somehow it was then teased out that in fact Kate Searle was the one who had filled in the information about Isla Bryson by name. So a bit like a goal being disallowed because it was offside? Although I imagine own goals can't be offside.

I thought Tuesday was bad; this was worse.

I was in fact so appalled by what I read today that I felt the most useful thing I could do to try to stop this nonsense was to bung some money towards Faye Russell-Caldicott, which I did. I had a little money spare because I cancelled my Lib Dem subs because of their TWaW nonsense.
