NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #39

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I agree. When I explained the situ to DH last night, his first suggestion was that KS had it in for SP and used the BU situation to settle a score.

Just a wee observation from today that demonstrates KS's bias (or commitment to the bit).

KS implies Wee Sondie blocked Upton's exit...

NC - he wouldn't leave or end conv till she did what he wanted
KS - not clear
NC - nothing stopping him leaving was there
KS - DU said maybe layout meant Sp was in the way
NC - blocking him
KS - between her and door

..while Upton's testimony from 10 Feb states the opposite.

I haven't watched any of the tribunal, either this time or the previous round. But it's interesting reading obververs' opinions of DU and contrasting them with KS's comments about DU's appearance, being a woman, not a man, not oviously trans etc.

I've only seen the photos in the press which are all soft-focus, sweeping hair, smiles, etc., and seem to give a completely different impression from what observers have said. Apart from the beardy photos and the hide-behind-a-scarf photos obviously.

I’ve seen him in real life, he was very obviously a man in a skirt. There is no way on earth anyone would pass him for a woman.

Definitely! They didn't exactly seem to be falling over themselves to declare their support for poor, distressed Dr Upton - their lack of responses to Searle's email was quite telling, I thought.

On a serious note, I think Miranda Hart would make good Kate Searle casting in the movie. The wispy page boy / posh gums combo, the boy craziness and the sly looks to camera - best supporting actress BAFTA should be a shoo in.

Twas actually a joke - I seem to recall IB was trying to suggest she wasn't just a trans ally but also an ally to stray kittens, pink things, soft toys the other protected characteristics (apart from actual female women coz reasons). She was suggesting her time efforts and lanyards were also given to other issues.

I wonder if KS, especially in her role as DU's clinical supervisor, was so anxious to fulfil her duty to be 'kind' to her colleague, especially if worrying that he could potentially report her to the GMC if perceiving her not to be kind, that this impaired her judgement somewhat. And wonder if that's why she kept saying that she is kind in the tribunal today. I mean, it's not kind to enable obsessive opposite-sex role-play but whatever professional guidance that can be found seems to suggest it is what one must do.

Didn't she have "trans ally" or LGBTblah or something on her emails? And she was questioned about not having other protected characteristics on there? (as I recall)

Honestly, if a DEI officer sent out emails like that there isn't a chance in hell I'd expect her support for women's issues.

Therefore, the NHS losing a good nurse due to the ideological position that gender is more important than sex (and therefore, transwomen - biological males - should use the female changing room, when the nurse in question wants a single-sex changing room, which is supported by the EA2010) is not an unfair thing to comment about this case.

Someone recommended the podcast "This Isn't Working" on another of these threads, the most recent ep is 3wk ago and the host mentions this tribunal, and says the same - an experienced nurse, sterling record, willing to do nights - they'd be nuts to piss her off, she's gold dust.
