NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #39

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I'm truly shocked that Searle. An A&E consultant is testifying under oath she would never have known Upton was a biological male if he hadn't told her.

This is beyond baffling. She looks like an utter clown. And a liar.

It's frightening to think of Mr Magoo prodding around one's insides with a sharp instrument whilst one is incapacitated on a table.

Dr Searle added: “If everyone was kind to each other and went about things in a different way, there is no reason for it to have come to this.”

I've noted that KS visibly hesitates each time she has to confirm something ridiculous. She knows how insane she sounds but she's caught in her own trap.

I think there is something more fundamental going on for KS.
She is telling us who she believes she is: she is a doctor, she is kind, she is trustworthy and honest etc.
This is her identity.

She is now having to face the painful discovery that that view of her identity is not shared by others. People really don’t see her as the person she thinks she is.

I suspect it’s shaken her confidence hugely.

She forgot about being kind to Sandy hey. She was a total bish to her.

Apparently Upton named her in the internal disciplinary as a potential witness. Kate was present at the meeting where Upton named her.
I'm not sure if there is a public record of this but shs already been named in the Fife internal proceedings.

Having trouble finding some (to me?) basic information about the original event, i.e. the encounter in the changing room. There's so much out there at this point, I've probably missed it. Reports say Upton was undressing.

So: was Upton, like, on the other side of the room from Peggie and facing the wall? Somewhere near her and facing her and staring?

The first would seem to be getting on with your business and, yes, having no right to be there, but only one level of intrusion. The second is serious harassment.

How did that encounter unfold? Is it out there on the record somewhere?

It's true unfortunately. I had that happen to me and even when I explained I was mixed race they proceeded to condemn the white English bit of me! I gave up at that point and blocked them.

I wasn't even promoting GC I was objecting to the idea that British nurses would have objected to sharing with changing rooms with black women. That's an Americanism of British history. And I had direct family experience to contradict it.

KS is weaving a very tangled web.

This part about resiling from an agreed fact in the face of contradictory witness evidence is fascinating. NC's side messed that one up.
