NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #38

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Interestingly, I'm at a very public, very busy tourist event and they have guards on the female toilets letting you in - but no guards on the men's.

No idea why. But does make you wonder.

The resumption of proceedings coincides with a few days off work for me, it only being half day chunks is a little disappointing. The GMC/MPTS take a very dim view of doctors being dishonest so if there has been collusion to withhold emails I do think that would merit referral. This despite the fact that the GMC records gender not sex on its registers 🙄

I whizzed the oats and banana in the blender, made greige wallpaper paste which wasn't coming out of the blender without a fight. Found another recipe that said add an egg, did that, whizzed it, the "mixture" was more liquidy (not by much though). Fried it, then made the horrible mistake of trying to eat it.

Nothing else said about it. It's as good as permission given.

It's just splitting hairs now but I think giving permission is not the same as instructing someone to do something.

Searle is saying she didn't tell him to, just that he could.

Likely irrelevant to the tribunal.

I think the main thing is that if it's true, Searle has finally realised that Upton has lied about her (or she's lying )

As fine as you can be with your reputation in tatters, which if you're used to getting a lot of respect might not be very fine at all.

Who is her reputation in tatters with though?

Think logically about this, she colluded with a group of people of similar status to her. Amongst those people, her reputation is intact.

I’m think this is parsing. If my employer asked me if I was happy to do something, I would understand that as meaning that was the proposed/ suggested/ preferred approach unless I objected for some reason.

Except for the fact he, according to KS, told her he had used f be in previous job and, in her witness statement, according to Foran and Herald who have accessed the bundle, KS had also claimed to tell him there were also GN facilities he was welcome to use. This wasn’t mentioned in the stand but is clearly, if to be believed, far from an instruction and implies to panel that the testimony in places of both witnesses lacks credibility. The use of the word instruction implies DU wasn’t given alternative from
start. Very different from what KS is saying.

she’s clearly a valued/respected member of the NHS, her job is safe regardless of the outcome. So no matter what comes of this, she likely has confidence that she’s personally going to be fine.

NHS legal shouldn’t be coaching anyone.

Maybe her job is safe since the NHS is the main employer of hospitals and the BMA / GMC is currently captured. But would I trust this woman if I worked with her? No chance.

She’s myopic, one sided, classist, defensive, involved in collusion in an investigation and thinks she’s above the law. So she will what comes to her in life. That’s my life critical belief.

Similar to this case in that the NHS colluded to push out an employee. Lots of NHS senior staff were admonished by the tribunal in that case, but a cursory glance on LinkedIn shows they stayed with the NHS.

And spot on about it being no problem for the then non- NHS people. Mrs Brain England from the disciplinary panel is easy to Google.

3 of the 4 members on that panel couldn’t explain why they had voted the way they did and she was one of them.

Bet NHS Fife legal team have done a bit of coaching given the terrible things witnesses have said so far. Between them they have bullied a nurse out of the department and have probably impacted upon her mental health all for the cause that women have to ‘be kind’.

As a counter point to the kid glove treatment of Dr Upton having multiple chats with senior staff in the wellness room, 20 consultants being informed of the hate crime against him in case he needed to go home in the middle of a shift or not come in at all, being escorted to his car by a consultant etc etc I give you the experience of a colleague of mine.

When she was a junior doctor, younger than Dr Upton is, her mother died, and her consultant refused her the day off for her mother's funeral. She had to scrabble around and find a colleague who agreed to swap. Once she'd done that, she informed the consultant who very huffily said 'oh all right, you can make the time up the next day'.

She was just a boring standard kind of female junior doctor and she'd only lost a parent not been asked not to use a changing room she didn't belong in though, so not really as terrible an experience as Dr Upton endured that had all of these senior female staff dancing attendance on him.

They will have had stonewall training telling them trans people will kill themselves if they are misgendered etc.

Not excusing any of it but setting the context.
