NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #35

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

"I have issued an employment tribunal complaint against NHS England for indirect discrimination on the basis of sex (women), religion (Islam), philosophical belief (gender critical) and disability (PTSD) for having a policy in place which effectively renders the supposed single-sex toilet, changing room and showering facilities as mixed-sex."

Neither is CM, she doesn't like JR putting words in her mouth, nor does the judge:
CM: I think inappropriate comment but not derogatory? JR: You described it as a hate comment. NC: Not sure it's OK for CM to answer that J: Yes - it's not a question!

The case of the trans prisoner Isla Bryson was only explained to Ms Myles ahead of the tribunal, she said.

Jane Russell KC is now re-examining Ms Myles. She asks whether she now believes the comments by Sandie Peggie were derogatory.
This specifically relates to comments comparing Dr Upton to a trans prisoner convicted of rape.
Ms Myles said it was certainly "inappropriate". She also described it in her evidence as a "hate" comment.
But Ms Myles said Dr Upton did not reference this specific comment in her statement.
If this was directly said to Dr Upton, it would be inappropriate, Ms Myles said.

It bugs me that NC didn't ask CM about which SEX those trans people in the rugby CR were. Because to me this whole thing is not about objecting to the presence of trans people, it's objecting to the presence of MEN where they shouldn't be.

Absolutely horrendous.

A comment that no one reported and the people in question do not recall and have no wish to follow up. But they felt the need to put it into public domain.

We're now discussing the alleged racist comment from Ms Peggie.
Ms Myles said earlier this was not formally reported and she had dismissed it as "hearsay".
Ms Myles said Ms Peggie used the term "P*" in relation to a consultant in the emergency department.
Referencing an alleged homophobic comment, Ms Myles said she was told Ms Peggie has a daughter who is gay. Ms Myles was told Ms Peggie was unhappy about this.
