NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Presumably Dr Upton is not the only transgender doctor in the country? So this is standard procedure? Would it also apply to a change of name by deed poll?

Given the answer to R Duffield's question in parliament today, does that mean the Darlington nurses have won their case before it has even begun?

Presumably Dr Upton is not the only transgender doctor in the country?
I read somewhere that there were 75, but don't quote that as definitive.

Also note that the GMC has fudged it by putting Gender, and not Sex.
If medical people purport not to know the difference, God help us.

Is NC allowed to mention the Darlington nurses case? Or other similar ETs coming through but not happened yet? I'm thinking when Upton and JR say only SP has any issues, everyone else is fine with it, could she say "well we know that there are other instances where female nurses feel strongly enough to take cases to tribunal, such as Darlington nurses."

Michael Forman is an academic at Glasgow University commenting on an Employment Tribunal in Scotland so I expect they do. Haven't followed his tweets but employment law is mostly legislative so more likely to align in GB. Not so sure about NI.
