NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

It's real. The minister was Karin Smyth I'm told. Waiting for Hansard to update for confirmation.

I think this is all quite crucial and the emails may go to indicate DUs behaviour towards SP.

DU noted SP entering the CR, leaving and waiting outside twice.

Yet DU didn’t log the alleged unprofessional conduct in their notes in terms of date, patient etc. Nor did DU complete the appropriate reporting at the time.

Given DU stated this was a serious incident why would they not report it at the time?

It makes no difference what the gov say in parliament about this issue as they are not doing anything to enforce the SS exceptions, or change NHS policy and practise. Words are free.

Well I certainly didn't know that you could leave an old GMC number behind! I've had colleagues that have retired, relinquished GMC registration and still had the GMC after them to investigate something.

Are there any other circumstances in which you can request a new GMC number?

Or is this another case of VERY SPECIALness?

On the face of it, it seems like a potential safeguarding risk. Particularly if the doctor does not disclose their previous name.

So combine a non-traceable GMC registration with an insistence that TW must be called a woman... that's gold for the next Harold Shipman

Could it be that the emails showed the BMA were quite enthusiastic about this case and that’s why it’s taking so long? Eight chains of emails may involve lots of emails.

Here's a suggestion of positive group action. We could all write to our MPs about this case, effectively using the Rosie Duffield question. I'd be willing to write to mine even though she'd probably be inclinded to spit on me for my views.

And to that Dr Upton has sworn blind that he's a biological female.
Normally you would take a person's word for it because it's pretty obvious, but he believes not in his case.

Finally caught up!

And thank you to those mentioning their pin was invalid, helped me to realise it wasn't just me being a luddite. Still not had a response from tribunal so I will be relying on those watching to be liberal with their swear words when we finally find out the contents of the non disclosed emails.

I don't know but you could put your questions to the GMC. I suspect they're going to be getting a lot of enquiries in the near future!

Yes, you'd think if there were such concerns about patient safety he would have immediately gone looking for the consultant on call to file a Datix about the serious incident, straight after it happened?
