NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

1000 replies

nauticant · 11/02/2025 11:57

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

The hearing is being live tweeted by https://x.com/tribunaltweets and there's additional information here: https://tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr. This also has threadreaderapp archives of live-tweeting of the sessions of the hearing for those who can't follow on Twitter, for example: archive.is/xkSxy.

An alternative to Twitter is to use Nitter: https://nitter.poast.org/tribunaltweets

Then hold your nose and get on Twitter or Nitter and use Tribunal Tweets. No one here is tasked with or offering a real-time account of what's going on.

Sorry, I didn't explain clearly. I'm here to discuss what's happening in the room. I have TT open in another browser window, but I'm interested in people's views on what's taking place and how the hearing is developing.

Shortshriftandlethal · 11/02/2025 14:03

Why are people here, if not for updates and transcripts?

If the court system keeps getting overwhelmed then there'll be nothing here but people asking how to access and how to turn their microphone off etc And what is the point of that?

Tribunal Tweets are providing the transcripts and they're nothing to do with MN. Tribunal Tweets have to apply to the court for permission to live Tweet. If any part of TT's account of what's going on in the courtroom appears here, it's because people who are on Twitter or Nitter are copying and pasting little bits. If you want an almost verbatim, real-time account of what's being said in the courtroom you need to register with Twitter or Nitter and search for Tribunal Tweets. This is a more general interest thread. If all you want is a transcript, go find TT.

There is still plenty of interesting commentary on the case, from MNers with relevant legal experience or NHS experience or other sources of insight. The thread title makes clear the thread is about the case, not about IT problems.

It would make sense to have a separate thread in future, for technical problems and instructions and comments related to how long people have been waiting to get access etc. I wonder if the speed at which these threads are moving might put off a more casual observer who may have benefitted from hanging around for some of the commentary. Part of what we want to do here is surely to peak people, like we have been peaked

If there's an appeal, which court would it go to?

The Employment Appeal Tribunal

Totallymessed · 11/02/2025 14:15

I'm someone else who thinks it would be really helpful for there to be a separate thread for people with issues with logging in. It is getting very frustrating, I'm not interested in hearing about people's PIN not working.

Yes, I'm personally looking at that too.......and switching between there and here. Nobody is logging on here for interminable questions about technicalities when we are all trying to follow the case step by step as it happens.

Indeed. There are many facets to this case (including access to the court) and you cannot really police what is discussed. It's a live thread and actually the more posts there are, the more people might clock on to it which can only be a good thing (imo).

oldwomanwhoruns · 11/02/2025 14:15

I guess that they are not merely reading the new emails, they have to print them all out and NC has to check the metadata to ensure that an email hasn't been 'forgotten'. So it's all taking time.

Tallisker · 11/02/2025 14:16

There was a bit earlier in one of the breaks where some microphones were left on, and I'm sure I heard NC saying to a court person that she expects to be cross examining Upton(ogood) until lunchtime tomorrow.

GCITC · 11/02/2025 14:16

Shortshriftandlethal · 11/02/2025 14:11

But we're mostly not here for a chat. We're here to follow the case.

I've not bothered trying to go in and view, myself, because it is easier if just a few do that....Since more and more people have been trying to log in - since yesterday - the list of problems is growing and all access was lost earlier. It may well be the system's fault - but the system is clearly not coping with the demands made upon it.

If people want to know how it works there are literally hundreds of other posts asking that same question throughout the thread -without multiples more every few minutes.

Edited

Who is the 'we' you refer to?

The numerous posts you have taken issue with show that info around joining is important to lots of people on this thread.

NebulousDog · 11/02/2025 14:17

Baroness Nicholson wrote one of her infamous letters to the GMC on 27 January (enquiring why men are being registered as women, citing Dr Upton). I do not believe that she has received a reply yet.

Surely helping people to access ET like this is an excellent way to peak people

Yeah, and that was before all of this carry on today.

So have another thread for just that, surely?

I've tried to rejoin, was WFTCHTJ, disconnected and it now says my PIN is invalid?

nauticant · 11/02/2025 14:18

If anyone wants to set up a "parallel" technical issues thread they're welcome to do so. They can post a link on this one and next time I set up a new thread I'll try to remember to include a link in the header.

Ooh, Rosie Duffiel d asking should female nurses be expected to change in front of men who identify as female?

The answer was no

If you want a thread that dies the same job as TT then start one, with your rules on what is and isn't to be commented on.

MJHereWeGo · 11/02/2025 14:19

Anyone else seen the Rosie Duffield clip on X where she asks the health minister should biologically female nursing staff be expected to change in front of their biologically male colleagues? And the HS says No ?

I am trying to figure out is it a deep fake!

If you can't access at the moment JK Rowling has been handing Dan Hodges his arse on twitter for telling people to be polite. Passes the time.

My concern would be that a technical issues thread will be read and posted on only by people who are having tech issues or not tech savvy. It would be like the blind leading the blind

PoshCoffee · 11/02/2025 14:20

Poster who are annoyed by the extraneous chat would be aghast if they’d been here for other tribunals. Loads of posts taken up on the benefits of support animals, tribunal snacks and the songbirds in Ben Coopers garden.

God I'm so glad someone mentioned food. Took a while 😅

I just had a bramley apple pie hot with double cream (after minestrone soup for lunch).
