NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

IMO, it's inconceivable that JR didn't explain disclosure to DU and how important it is. He's just chosen to ignore it and I suspect it suits JR to take the blame rather than admit she's been hoodwinked by DU.

It would be undermining to her case if she admitted that the arrogant doctor had attempted to control her ...

Unconvinced by JR's mea culpa except to the extent she was covering BU from outing himself as a complete liar (I know.....) Would not like to be a party to the conversations amongst Jennifer Thomson, Andrew Watson and whatever junior solicitor in CLO was handling disclosures.

I am now getting an invalid pin message to after watching all week. Was working before lunch. Just emailed them for a new pin. Don't hold out much hope. Relying on anyone who's logged in.

It’s the same for me. I was WFTCHTJ for ages, then it went back to the joining screen.

whether I do cut/paste or type in the PIN, I still get the ‘invalid’ message.

Edit: the relevant tab on my iPad is different, too. It now says ‘Kinly clo…’

A deliberate failure to comply with disclosure - by which I mean deliberately withholding unfavourable documents - would be a massive conduct issue for both solicitors and barristers. I very much doubt they would be so stupid.

Re Invalid Pin, I'm getting the same message too (assumed it was me, what with being a total techniphobe). Have also just emailed back explaining and asking to be allowed back in.

Hopefully those of us chucked out, can get in again.

You're correct; I just checked. Both old and new Dr Upton are on the GMC register, with 2 different registration numbers. (The previous Dr Upton is listed as having relinquished their registration).

It already looks deliberate - they were supposed to disclose BMA correspondence over the weekend (as already late and in breach of the order). Why wasn’t this disclosed ? Forgotten (DU) or not relevant (JR) or in error ( J R again)

IANAL. If the GC views win then the trans community will not be happy. If the trans community views "win" will you happily accept the result? Nope - more interogation of the facts will surely be happening

If you are getting the invalid pin, you need to email edinburgh. They will give you a new link, no pin needed.

I got a reply within 2 minutes.

Re Invalid Pin - I've just spoken to their contact centre who said there are so many people trying to get in now that they've had to create new rooms and they're moving people between them. I'm also getting the invalid pin message. They told me to email in to ask for a new pin.
