NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #10

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

It is all such garbage. He works in A&E. When someone is dying right in front of him, he's not going to stand there waffling about cis or large or small gametes as he will get his arse kicked by the senior medics and get a professional conduct complaint as his navel gazing can cause someone to die. He only indulges in this claptrap when he feels like it.

I'm not watching or listening but, from the reports, I don't think there is any need for NC to pull this back. She is giving DU plenty of rope and letting him use it to hang himself. She doesn't need to challenge him.

The kind of aggressive cross examination you see in on tv or in films is not realistic. There are limits to what a barrister can do. You can ask, "you left your daughter alone for 2 hours, didn't you", but you can't ask, "you are a bad mother, aren't you". It is generally a bad idea to accuse a witness of lying, or to comment on the quality of their answer, or to argue with them when you disagree with their answer - all things you see regularly in dramas. However, you can comment on the quality of a witness's evidence in your closing remarks.

No it's not possible to tell from looking at someone if they've got a history of sexual trauma, but it's entirely possible to tell by looking at you mate, that you're a bloke.
