NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #8

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

I think that was clever of NC, she got DU to agree that the whole thing rests on his belief that TWAW. SP doesn't believe TWAW, and of course that is a legally protected belief

Interesting to note (going back a bit) that Upton was able to generalise the feelings of the women in the changing room when it came to bigotry, and went to his manager to get confirmation that she would back him up if/when one of the bigoted women complained, but said he could NOT generalise as to why women would be uncomfortable changing with men because everyone is different and it's impossible to generalise.

DrU's evidence is so different from Sandie Peggie's. Hers was straightforward and sincere.

DrU has been evasive, slippery, trying to make legal arguments, JR having to interrupt.

It's like night and day.

NC - you must have known because SP klnew you were a man and she didn't want to change in front of a man.

BU - I'm not a man. I presume to do with my trans status. Whenever you see someone you make a general assesment, my gut instinact was hostility from SP towards me, likely cause my trans status, I presumed she wasn't wishing to share a space with me, that was her decision'.
