NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #3

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

Had to set up a new account but I've been posting on here all week. I just can't get past SP's mum having to come here and talk about how her daughter didn't want to discuss soiling her clothes with blood in front of her Dad, and her whole family at Christmas. I genuinely hope JR is ashamed

I think the thing to remember here is that the tribunal is not asking whether or not upton should have been in the female only changing room.

They're asking whether the NHS was right to label SP's complaints about Upton's use of the changing room as bullying and suspend her as a result.

The reason this is so important is because if the NHS win, they are effectively saying that asking a man to leave a female changing room constitutes harrassment in the work place, and therefore women with jobs outside the home can kiss their female only spaces goodbye. Workplaces will be able to label them single sex but if a man uses them and a female member of staff asks him to leave, it's workplace harrassment.

We've gone from the right to equal pay in 1969 to it's bullying if you ask a male member of staff not to watch you get undressed in the female changing room in 2024.

I'm lurking on this thread, largely because I don't feel I have anything useful to add apart from cheering on from the side lines but your post @CheekySnake really resonated with me. It is a really frightening idea that this could happen should the NHS win. I have 2 daughters and this is definitely NOT the world I want them growing up in.

I wonder if him having to appear here and being stressed and scared, maybe embarrassed etc will twinge any feelings of empathy within him as to how the women feel every time they walk into a changing room not knowing if there will be a man in there or not!
