NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #3

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

@Kucinghitam As I’ve already said here (sorry), I’m worried that the judge will be a ‘just be kind’ adherent. I recently had a very senior barrister tell me indignantly that if a man could pass as a woman they should of course be allowed into women’s spaces.As though that was the test, ‘passing’.

I'm not sure about SP but the point upthread about publicity and derogatory remarks possibly meaning that future hearings are made private seemed plausible. I'd prefer to avoid doing anything that would result in these sorts of hearings being hidden away

But saying we should not talk about certain aspects of a case IS hiding it away. If it is raised in court then it is reasonable to discuss. That includes saying DU does not pass or that.he has made an extra effort to try and pass when passing=deceiving.

I'm not sure Sandie will have to go before the NMC as the charges weren't serious, like stealing from patients etc. Her employer was proposing to put her on supported practice by the look of it, which is why they wanted her to switch from night to day shifts. She's been qualified for about 30 years, let's not forget, and has always worked for the same employer. Then the newly-qualifued Upton rocks up ...

I suspect suggesting moving her onto day shifts was because they knew she couldn’t do those. Ie a way of driving SP out, while not appearing to do so.

I'm not following this discussion about emails and phone calls to the BMA. Is NC saying that DrU disclosed this late (late night?) and they need to see what was said?

Totally agree - but some things being said here are sailing a bit close to the wind. Slightly wild assumptions about motivation mostly. Sorry I don't have any examples to offer - and don't have time to look back - but a couple have made me wince.

Although many have made me laugh - which is helping me deal with my outrage about all this. Thanks everyone for your insightful comments.

And don’t forget that Jane Russell, while questioning Maya Forstater, threw in ‘and someone here has accused you of being involved in terrorism’ and leaving that there, moved onto to other comments made by random people about her. Paraphrasing.

Still wonder if changing Maya’s name on repeated occasions to make a scatological reference could be just an accident on the part of Jane Russell.

I agree this is a good reason for caution esp re any discussion on the appearance of BU or making speculation about his personal circumstances including his mental health etc.

I didn't view Monday's and Tuesday's proceedings live, I only read Tribunal Tweets threadreader.

I was surprised that Jane Russell seemed to keep referring to Dr Upton as "he" and "him"!

I wasn't sure if she was actually saying that or it was a transcription error by Trib. Tweets

This interaction about requiring the BMA to respond, or not, is interesting...NC suggested she needed to do that, and then the judge made the rather obvious points about how long it would take, and NC said that was a reason to withdraw it. A pre-ordained dance?

BU is a Doctor in the NHS. If he is practicing sex deception (which it appears he is, his employer is and is forcing all other staff to too) this will have relevance to many patients, that's open to comment by any prospective patient, surely?

Not only women but men require single sex care for multiple reasons including their religion. One such religion is Islam, Muslims may need single sex spaces / care.

The way NHS fife are behaving is quite Islamophobic as well as sexist, bullying and dishonest.

Wasn't it the case with the Darlington nurses that some women had to wear two layers of clothing to work so as to be sure not to undress in front of a man, given it was clear the employer had decided (without telling anyone) that all spaces were mixed sex at that point?

People can do that after the case without the risk of jeopardising it.

First "5 minute" break at 10:48...

It sounds as though NC is concerned about an allegation about SP's behaviour in the resuscitating room where she may or may not have left a patient unattended because of not wanting to work with DU - perhaps covered in the last couple of days when I haven't been able to watch? - which "appeared and then disappeared and then reappeared". Maybe correspondence with the BMA that may have related to the implications of making, or not, such an allegation might make a difference to how credible DU's and/or SP's evidence is considered to be, when they differ? Not sure, I'm pretty lost.
