NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #3

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

Whether or not we think appearance is irrelevant, that the respondent is arguing it is means it is appropriate to discuss that argument. Especially if JR is saying ‘you would never know’ when it is clear.

I'd also add to the pp's ideas (pity, compassion, fear) the motive of 'power play', which can be performed by women over other women. Some of the biggest power players using gender ideology to try and crush 'uncooperative' women in the trades unions and universities with which I'm familiar have been other females.

It's very sad that so many women see gender ideology as a route to the top, and harness the fear and female socialisation (pity, compassion) of other women in the workplace to accomplish this.

Yes agree, good point, this ideology can be used in power play and to bully and abuse. As is so aptly demonstrated by this case.

That is a very good point. It was the sheer number and very 'normalness' of those men that was so shocking; what they were prepared to do covertly. Obviously this was not so publicly known in 2023 but it would be a useful example for the defence - especially if JR was quoting magazine articles...

How can random angry women who want single sex spaces in any way be used against SP? Surely if that's the case random male predators like Pelicot, Dolatowski, the wii spa guy who like free access to women's spaces can be used against Upton?

I'm not sure about SP but the point upthread about publicity and derogatory remarks possibly meaning that future hearings are made private seemed plausible. I'd prefer to avoid doing anything that would result in these sorts of hearings being hidden away

SP has a connection to her husband that she doesn’t have with the women on this thread. And the judge already queried what the relevance his posts had to the case.

Do we know how Sandie is funding this case? Is her union supporting her (unlikely)? I don't think she crowdfunded, did she?

I saw something on Facebook by her daughter who is trying to encourage people to go down to the court on the last day to show their support for her. I wish I could go.

Do we know who the witness today is? Is it SP's or the other sides?

Her former MP - Neil Hanvey, a former nurse - put her in touch with people who could support her, I recall.

Though she managed to make the questioning of MF about Helen Joyce too........She's obviously well versed in the trans activist perspective - just not of the persepctive of her opponent...to her major fail.

@Kucinghitam As I’ve already said here (sorry), I’m worried that the judge will be a ‘just be kind’ adherent. I recently had a very senior barrister tell me indignantly that if a man could pass as a woman they should of course be allowed into women’s spaces.As though that was the test, ‘passing’.
