NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #3

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

After I retired, I had an ortho appointment at the Vic. The consultant who saw me - and told me that they couldn't consider knee replacements for at least another 10 years - explained that my problems were genetic: each knee falls into the category of patella alta - the arthritis is only a contributory factor.

I nodded and (in Standard English, albeit with my Fife accent) said "Thank you - at least I know now."

"Oh, you won't understand what "patella alta" means..."

"I did Latin at school. I presume you're telling me that my knees sit higher than they should." (No, I didn't say that in a snotty manner.)

He seemed rather astonished.

With other doctors at the Vic, I noticed that their attitude changed somewhat when I gave my profession as "teacher" or "retired teacher".

I'm assuming SP's husband has been called on behalf of his wife?

I'm not sure what evidence he can give on her behalf, and I'd have thought his cross-examination could potentially harm the claim?

I don't think it will harm her claim. It's got nothing to do with whether or not the NHS and BU discriminated against SP. Even if SP's husband is "Islamophobic" or a bit racist, SP is still entitled not to be discriminated against at work.

Presumably no colleague is going to appear in her defence having seen the lengthy suspension NHS Fife doled out alongside the extensive note taking to record behaviours such as eye contact, language, manner of entering or leaving a room and all the other submissive behaviours required from women colleagues?

Why is JR repeatedly calling Maya "Forshatter"? I've heard it several times very clearly now, and it seems an unlikely mispronunciation.

Is it that she denigrates Maya by calling her this in her conversations with TRAs outside the courtroom, and so it just comes naturally? Is there another explanation?

If she is indeed goading Maya into objecting, so she can pounce on it being upsetting when you're called the wrong name, Maya not reacting is going to make that tactic backfire.

Constantly calling somebody a derogatory version of their name, over and over, just looks like deliberate bullying.

All the skills and years of experience that Maya has, and JR tries to claim that she can't comment on issues because she's got an agriculture degree!
