I do think it could be possible to prevent transwomen losing rights around discrimination and equal pay if the act was tweaked carefully ( eg for equal pay both female only and grc could be identified as being expected to be treated fairly

They would still be able to argue discrimination on the grounds of gender reassignment. However, as a male their pay comparator would be a female not another male. Trans men on the other hand would get a male comparator. That may well be a fairer outcome unless you think trans women are more likely to be disadvantaged than trans men?

One lawyer has pointed out that they would still protected if they were paid less because they were assumed to be female (unlikely) anyway. They would also still have protection using GR characteristic.

That would be a great way forward. I think the Tories appointed Baroness Falkner to the EHRC in the hope that she would roll back some of the 'trans overreach'. EHRC laughably did used to be Stonewall members after all along with all the other Government quangos and departments.

I don't see why, though. Those laws were introduced specifically because women are disadvantaged by their biology; to include males in them would make a mockery of them.

Especially as transmen will still
need the workplace protections of sex, either in terms of protective equipment and clothing (sized for the female body) and some will need maternity rights too.

This would effectively clarify things back to where the vast majority of people already thought they were, until the debacle in Scotland opened people's eyes to the reality of self ID. I hope this happens. Labour would then have to justify any future changes.

This would protect the sex class women, groups such as homosexuals, freedom of association, hospital wards, etc. It would then be possible to look at individual information in the areas raised that might affect TW to specifically manage those situations.

Unfair pay is mostly related to maternity and pregnancy. It mostly kicks in for women after they've had kids and there is also an element of women who may become pregnant being discriminated on that basis. None of which apply to transwomen.

However, everyone should have a right to fair pay and I'm sure the gender reassignment characteristic would apply if a man was paid more than an transwoman in the same job.
