I ordered 2 make up bits from eBay.
They arrived and the next day a bottle of perfume came from the same seller (worth £100)
A week has passed and the seller has been messaging me asking me if I'm going to send the perfume back.
Then saying I can see you have it as it's been signed for (I didn't sign for it)
I paid by debit card
Can she do anything ?
Would you return it?

@rryyg

I was planning on returning it It's just her attitude stank and she didn't even give me a chance to respond before she got nasty
Of course you were

That's not what you implied in the thread title or indeed your OP.
MyCatEatsPrawnCrackers · 01/03/2022 15:53

@ToMockAKillingBird

Similar has happened to me, we ordered 3 conservatory sofas and we received 4. Left it in the garage for ages but it was never collected so I sold it 🤫

Get the seller to either collect or send you the p&p costs and then return it.

Did you inform the people who sent you the fourth sofa? If not, you're a thief.

@LetHimHaveIt

I know what the law says, thanks (LLB Hons 2001; LLM 2004; College of Law (Bloomsbury).

AT THIS TIME, OP is not a thief - she has simply yet to return an item sent to her in error. If the seller thinks otherwise, she's welcome to call the police, and pass on OPs details. See how that works out for her.

Clearly, OP needs to send it back/allow it to be picked up. But people also need to stop wringing their hands over a hypothetical plucky small business owner who needs that £100 to put food in the table. She fucked up and yet appears not to have accepted it as her mistake. Still; there's a lot of it about.

Totally agree but my knowledge of the law comes from teaching Year 10/11 and having to write references for their twoc offensives, taking without the owners consent, ie joy-riding!
toastfiend · 01/03/2022 15:55

I'd return it, provided she paid for postage and sent me a returns label.

XenoBitch · 01/03/2022 15:56

Of course you are BVU, were clearly thinking of keeping it, and was after the validation for your choice from MN.

Being a business seller does not mean she is a big company that can absorb the loss of £100.

I hope you do the right thing, and return it.

babyjellyfish · 01/03/2022 16:00

I'd be really annoyed by this.

At the very least the seller should be apologising to you for the inconvenience and asking you nicely to send it back (subject to them transferring you the cost of postage first).

Even then I would be irritated about having to take the time out of my day to deal with someone else's mistake.

IMO they should write this off and be more careful next time.

@CatJumperTwat

Laughing at all the wannabe lawyers on this thread.
And I am laughing at all those on this thread who don't know the definition of the simple word 'theft'', The yob who takes your car for a ride round isn't guilty of theft, unless it's a top-of-the-range car that is sold on abroad.

Why would you even ask. If its not yours dont take it. Ask her to pay for return postage. I doubt she wouldn’t mind because it cost £100. Returns postage will be nothing. It seems you doesn’t want to return it, you asking ‘what if she doesn’t want to return it’ which i doubt. I think You are just wanting to know if there is any other who wants to keep it if she is in your shoes. Don't keep anything that doesn’t belong to you.

Keekabooyou · 01/03/2022 16:05

Yes it’s the sellers mistake which they should acknowledge, but for goodness sake send it back. Should you steal £100 bottle of perfume from a shop?

Notwithittoday · 01/03/2022 16:07

Tell her to send you the postage money in advance, then return it. She may not bother

bruce43mydog · 01/03/2022 16:08

Its not yours, you must return the perfume. get the seller to pay for postage and package

Chakraleaf · 01/03/2022 16:09

Yes because you would be pissed off if this was reversed.

BitOutOfPractice · 01/03/2022 16:12

Her attitude stank? Grin

skodadoda · 01/03/2022 16:13

@rryyg

What if she won't pay the postage costs of me sending it back ?
Post it with no stamps, then she will have to pay to get it
QuelleSuprise · 01/03/2022 16:13

@BattenbergdowntheHatches I would bet a lot more than a fiver 😂

ExConstance · 01/03/2022 16:15

I understand the legal situation is that you make it available for collection or ask her to send funds for return by post. if she doesn't do that you can keep it after 6 months.

ifIwerenotanandroid · 01/03/2022 16:16

Seller may have difficulty sending you a return label because there won't be a record on ebay of a transaction involving you & this perfume, because you didn't buy it from her.

Remember that there's a real person on the other end of this. Message her via ebay, be nice & ask her how she's going to refund the postage. Perhaps she could do a PayPal payment once she's got the perfume back. Then don't mess about. Just send her back her £100 item.

And yes, you would be totally unreasonable to keep it. I don't know why you haven't sent it back already. It's a mistake. It's not yours to keep.

Seee · 01/03/2022 16:16

Ask her to send you a myherme print in store label, much easier!

Juno22 · 01/03/2022 16:17

I suspect the OP can't return it because she's already using it.

WisherWood · 01/03/2022 16:17

I'd just have contacted her when it turned up and said 'you sent me a bottle of perfume by mistake. Please send a prepaid postage label and I'll stick it in the post when I'm passing'. Problem with a courier collection is I'd be waiting around for them and I hate doing that for my own stuff, let alone someone else's.

People tend to respond nicely if you do the decent thing and if they don't, well that's on them.

TidyDancer · 01/03/2022 16:18

@Juno22

I suspect the OP can't return it because she's already using it.

I wondered this.

OP of course it needs to be sent back but you should ask for postage or tell them to come and collect it.

Loki01 · 01/03/2022 16:18

@rryyg

What if she won't pay the postage costs of me sending it back ?
Ask her to arrange to Hermes pick up. That way she pays for it.
DameHelena · 01/03/2022 16:19

I don't quite understand. It arrived and what –you didn't do anything like say 'you've sent me this by mistake'?

What's happened in the week that's passed? Did the seller message you from the start being nasty?

Why are you asking if people would return it if you were planning on returning it anyway?

But to the practical point: I'd weigh it and tell her what postage costs, then ask for the cost upfront before returning it and sending her proof of posting.
