To think that a 12year old doing this is wrong?

Today I found out that my 12 year old niece is sexually active with her boyfriend. I know that her mum (my sister in law) knows what she is doing, and hasn't said anything to her / isn't bothered.
I feel that this is wrong and she shouldn't be doing this sort of thing at the age of 12. The thing is I don't know what to do.
Any advice on this will be greatly received TIA.

I am pretty sure it is statutory rape regardless of age of boy. Although if boy same age he is obviously just at risk etc.

Any person under 13 cannot legally consent to intercourse. All sexual activity under 13 is abuse and needs reporting to the police and social services

if you read the thread several people have stated that if they are both under 12 then BOTH need protecting ...

also reported this as it needs addressing = hopefully HQ can investigate

I should think same counts for boy too as neither can give consent. Parents at fault and op if she does nothing.

I know that her boyfriend is 14 the same age as her older brother.
I found out when I was at my SIL' s house earlier today, we were sat in the kitchen when my niece walked in and asked her mum to buy her some more condoms. At this I asked my niece why she wanted condoms. She told me she needed more as she had run out. So I said to her that I hope she isn't having sex at her age she is too young. To which she said that she was and that it's nothing to do with me. I said no more to her at that point as I know she has an attitude, and I didn't want to argue with a 12year old.
After she left I spoke to my sister in law and asked her how long she had known and why she hadn't done anything. To which she replied a bit and its fine it's her life.
My sister in law is a single mum of 4, she has no rules in her house, and let's her kids do as they please.
Social services are involved with her, and have been out on several occasions, with nothing coming out of it.
I told her my concerns and all she could say was to repeat that it was her life and that I should leave her alone to do as she wants.

if SS are AWARE she is having sex they will act ...so do something about it

How has the mother shown that she isn't bothered? she may just be embarrassed to talk to you.

It would be an incredibly difficult position to be in as a mother. Knowing is the first step, doing something about it is something to tred carefully with. I wouldn't want to scare my daughter away from speaking to me but nor would I want it to continue happening.

You need to call social services and raise a safeguard alert and/or call the police

Your niece is being abused no matter how grown up she thinks she's being

Sexual intercourse with a twelve year old is always and automatically rape (statutory rape). The age of the boy is not relevant and it is a police and child protection matter. If she was fourteen and the boyfriend was a similar age or would be inappropriate but not necessarily be child protection. If she was fourteen and her boyfriend was older / there were further vulnerabilities etc., it is again child sexual exploitation and abuse.
OP this is not a matter to discuss in a forum. This is an urgent child protection matter, quite possibly in regards to both children

Worra is he was 10 and she was 12 SS would act to protect both children and the parents could be investigated and possibly prosecuted

They wouldn't charge a 10 year old with rape

None is blaming the boy ( although the law re rape at. 14 doesn't count). If he were 12 or under it applies the same. I couldn't care less her mothers circumstances.

Please go straight to the police or social services, this girl is far too young at 12 to be having any form of sexual contact
