To think that a 12year old doing this is wrong?

Today I found out that my 12 year old niece is sexually active with her boyfriend. I know that her mum (my sister in law) knows what she is doing, and hasn't said anything to her / isn't bothered.
I feel that this is wrong and she shouldn't be doing this sort of thing at the age of 12. The thing is I don't know what to do.
Any advice on this will be greatly received TIA.

12 isn't an older child though, the law doesn't even see them as an older child as demonstrated by consent laws. An older child is 15+


In the UK we have no legal definition of an 'older child' it does not exist legally you are a child if you are under 18 end of.

At 10 you are deamed criminally responsible (but in most areas at the moment its almost impossible to get an under 14 actually arrested for anything less than murder due to a desire to massage the juvenile arrest figures)

Under 13 you can not consent to anything BUT you can refuse consent for pretty much everything and that has to be taken into account.

At 16 anything that you still need parental consent for can be bypassed by court order if you apply.

Inbetween it all we have Frazier competency this can be considered at any age as there is no set age for reaching competence and is now no longer used just for medical treatment but its quite cut and dry when applied to certain topics,quite rightly an under 13 seeking medical treatment relating to sexual activity should always result in a referral as should an over 13 who is not FC.

For the purposes of education health and social care a child's wishes and feelings are a lot more important than many parents imagine

Services will treat secondry school age children as older children
