NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #41

nauticant · 24/07/2025 14:08

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Why should it only be SP who gets punished for "misgendering"?

Because she was the only person who was openly a heretic with respect to gender identity ideology.

If you claim to be a believer, and those around you accept this, then your sins will be forgiven,.

I rather think that’s the point, she has nothing else. NC is clearly just much better at her job than JR is.

or in fairness has an easier job in this case!

NC on to pronouns now, Art 8 rights to dignity etc.

Article 8 does not state you need to use pronouns. It states everyone has a right to dignity.

This includes women.

Forgiven but only after appropriate grovelling and self flagellation...

TheywontletmehavethenameIwant · 24/07/2025 15:41

The only mis-gendering going on is from BU, all confusion stems from his lie.

RedToothBrush · 24/07/2025 15:42

Article 8 is not a trans charter to do whatever the fuck you like.

MarieDeGournay · 24/07/2025 15:43

NC, complainant says reported issue to manager, which is ED, so not right
AH - yes
NC - your email to SRainer and MJorganson, say you spoke to GM that SP had escalated concerns about F CR, ED didn't escalate, GM looking at who to pick up
👌

You can’t make a silk purse out of a sow’s ear, as the saying goes.

MarieDeGournay · 24/07/2025 15:38

NC - your HR colleagues were sceptical of SP leaving cubicles when patients needed her. Say have no evidence she walked out.
AH - we didn't have any evidence, no statements at that point, i was on leave, not involved in chain. JH said we as a team had no evidence at that time.
NC - you never had any
AH - we did from beth
NC - you knew that from DU
AH - no formal statement yet

So 'Beth says' = 'evidence'

And saintly, marginalised, vulnerable DU must be believed or we will all be damned. It’s pathetic.

Shades of the Garden Court case. Everyone is on sick leave/holiday/work hours don’t coincide. And Christmas, of course.

However the lack of people reversing into bins remains disappointing.

Give it time!

Largesso · 24/07/2025 15:39

Agree. Is this not also trying to claim the internal disciplinary found fault with SP for not handling at she should have done? That the onus was on her to escalate even though her line manager didn’t give her that option?

Also, once SP had been suspended, escalation would've seemed a moot point. She was put on the defensive, realised she'd get nowhere internally, so went for legal advice. I think I'd have done the same.

RedToothBrush · 24/07/2025 15:42

Article 8 is not a trans charter to do whatever the fuck you like.

Apparently it is if you’re DU and you work at Victoria hospital.

Boiledbeetle · 24/07/2025 15:44

Is there even one tiny slither of anything NHS Fife did that was in line with their policies and procedures when it came to Sandie?

CM’s review of the suspension,

Gymnopedie · 24/07/2025 15:46

I was so engrossed in catching up I didn't realise when the train got to my station. Now going back on myself to where I should have been.
TBH I'd forgotten I was even on a train.

KnottyAuty · 24/07/2025 15:46

Delphigirl and @prh47bridge were talking about the likely SC interpretation by both sides in submissions. And if SP wins then Fife appealing on the misinterpretation of SC…. Given how badly they are going to fail on all the other charges do we really think that Fife have any appetite for more punishment? Given that Scotgov have already queries how they let this get to ET I can’t see Whitney supporting an appeal with Scottish elections coming up in 2026…. What do you think?

MarieDeGournay · 24/07/2025 15:46

NC - any comparable email to SP, why change of ix, progress or why ED not involved
AH - would have expected it, from ED or GM
NC - sure JR will take you to it if it exists

ouch!

People have been asking how to show their support to Sandie and Naomi.

Is there any way we can show our support and gratitude to you @nauticant?

Yes. I've been here since the start, with name changes. I haven't really contributed much, as mostly I'm lurking. I'm very grateful to nauticant and everyone who has made it possible to follow this, and other, cases. It's been so important that everyone has a chance to see what is happening,

PennyAnnLane · 24/07/2025 15:47

This case is a perfect example of why gender identity should never have been given legitimacy through the equality act, if I say I identify as King Charles and insist in being called your majesty I rightly wouldn’t be given a customer facing job, or frankly much respect, but a man can walk around demanding to be called ‘she’ and people are falling over themselves to force others to comply.

anyolddinosaur · 24/07/2025 15:47

No rational authority would appeal - but this is Fife......

JR: " It's different you know - when we do it"

Edited

Well it has to be, given JR has also done it.

NebulousDog · 24/07/2025 15:48

Why did it take them in excess of 6 weeks to realise that ED was compromised? Surely ED must have had some sort of training/written guidance?

BeLemonNow · 24/07/2025 15:49

NC - was anyone reported for misgendering in this report?
AH - no
JR - it is different using they them to she her and he him
J - point is not she/her

Starting to feel sorry for the judge now.

Not sure how transgender bullying type policies are written but presuming it is refusing to use preferred pronouns? Different from using neutral pronouns?
