NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #41

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Why should it only be SP who gets punished for "misgendering"?

Because she was the only person who was openly a heretic with respect to gender identity ideology.

If you claim to be a believer, and those around you accept this, then your sins will be forgiven,.

or in fairness has an easier job in this case!

Article 8 does not state you need to use pronouns. It states everyone has a right to dignity.

This includes women.

The only mis-gendering going on is from BU, all confusion stems from his lie.

Article 8 is not a trans charter to do whatever the fuck you like.

And saintly, marginalised, vulnerable DU must be believed or we will all be damned. It’s pathetic.

Also, once SP had been suspended, escalation would've seemed a moot point. She was put on the defensive, realised she'd get nowhere internally, so went for legal advice. I think I'd have done the same.

Is there even one tiny slither of anything NHS Fife did that was in line with their policies and procedures when it came to Sandie?

Delphigirl and @prh47bridge were talking about the likely SC interpretation by both sides in submissions. And if SP wins then Fife appealing on the misinterpretation of SC…. Given how badly they are going to fail on all the other charges do we really think that Fife have any appetite for more punishment? Given that Scotgov have already queries how they let this get to ET I can’t see Whitney supporting an appeal with Scottish elections coming up in 2026…. What do you think?

Yes. I've been here since the start, with name changes. I haven't really contributed much, as mostly I'm lurking. I'm very grateful to nauticant and everyone who has made it possible to follow this, and other, cases. It's been so important that everyone has a chance to see what is happening,

This case is a perfect example of why gender identity should never have been given legitimacy through the equality act, if I say I identify as King Charles and insist in being called your majesty I rightly wouldn’t be given a customer facing job, or frankly much respect, but a man can walk around demanding to be called ‘she’ and people are falling over themselves to force others to comply.

Why did it take them in excess of 6 weeks to realise that ED was compromised? Surely ED must have had some sort of training/written guidance?

Not sure how transgender bullying type policies are written but presuming it is refusing to use preferred pronouns? Different from using neutral pronouns?
