NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #39

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

My NHS emails never permanently delete either. And as PP's, I have to manually delete them from the deleted fiolder.

I work for another Board in NHSS - it's exactly the same here. I have emails going back several years in my sent items, longer in some of my folders, and emails in my deleted folder that I have moved there get emptied once they get past 1000. As I am not the best at remembering to do this I regularly sit with a full deleted folder. IT do not need to know this.

Unless NHS Fife have a very different system Searle has either set an automatic deletion on her inbox and sent items, or is lying through her teeth - and if I were a betting woman I'd be at Hills with £50 on the latter.

Ex-NHS Fife here, and definitely no automatic deletion of emails during my time.

Emails SHOULD be deleted according to retention policy (which varies depending on what the email is about) but it's not forced through any automated process, or certainly wasn't when I worked there.

And going back to the 'Re:' email subject discussion, it's usually possible to see if an email is a reply by looking at the email headers. Was there not talk of an IT forensics type person being questioned at some point?

She may well have been totally stitched up by Lottie Myles who has clearly prepared well. LM’s evidence did have holes in it, but by presenting herself as the voice of reason and being familiar with her evidence she became a far more credible witness (imho). Much better political operator than KS who may have overrelied on her self image as a kind, honest and trustworthy consultant. And who appears to even now, have no idea that her actions were completely inappropriate as a senior leader - one that should have recused herself from any role in the aftermath of the CR incident if she could not adopt a disinterested approach.

As NC herself pointed out, at the mention of the name Rhianna KS looked shocked. Then cried.

Maybe she means 'archived' rather than deleted. Nothing gets deleted (like properly deleted) in my experience.

Thought 7 years was the commercial "norm" for any records.
Would have thought it would be longer where medical records are essential to the care of the individuals.

That’s for financial records. medical records are kept separately from emails ie emails aren’t part of that record. If anything arises in emails it would been to be written in a report and added to the patient file.

My read is that what KS was referring to was that emails in the waste bin are automatically deleted after 30 days - not from your inbox — which implies she tries to delete it.

Thanks. It sounds like it will be a very interesting read so I hope someone will be hunting for it in the bundle and copying it out. I didn't go into KS day thinking the 'smoking gun' email would be eclipsed by the 'dripping with blood, covered in finger prints' email. They really should have thought of a better hiding place than down the back of the sofa.

Yeah my experience is in local authority/ central gov. I'm a bit out of step now but a 30 day auto deletion would be utterly insane.

have attempted to transcribe using audio recognition software in the past - it was not accurate as did not understand Scottish accents!!

I've used speech to text as well and it also messed up unless I spoke very clearly and slowly (which people don't always do) so I can see why they still use stenographers.

I would have thought they would have access better tech than the apps I use though. The transcription app on my phone is quite impressive but it still makes mistakes.
