NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #39

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

When KS did her own search for emails she searched Inbox and Sent. What about other parts of the file structure? For example a folder specifically for this matter?

Is it possible that the judge is saying things to scupper any appeals on the grounds of him not having been fair enough to Fife, should they lose?

At this stage the judge will avoid saying anything that would appear to show that he has already made up his mind on any of the points in issue. Since JR has made it clear that she intends to argue that the SC judgement only applies to representation on public bodies, the judge cannot say anything that indicates he doesn't accept that as a possibility. In that respect, I think NC would have been better referring to the judge's previous decision allowing SP's team to use male pronouns for Upton.

I assumed She said/she said was used to discuss DU and SP to carefully avoid it appearing as if they are referring to DU as a he.

IME he said/she said only really used to talk about male violence like DV and rape. So maybe that’s the inference these 2 witnesses (and Fife legal strategy?) want you to take, that SP is an aggressor.

Can't they just use an audio recording and use a speech to text transcription. Seems it would be much cheaper.

KS finally seems to agree that "biological sex" is a thing but then in answer to another questions suggests there are "other possibilities" in addition to the two sexes, for example XYY.

Although if it does turn out to be the mad bastard option that wouldn't come as a great shock. Imagine having to run an emergency medicine department alongside that.
