NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

nauticant · 22/07/2025 10:21

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Technical question.

Can someone advise me if there's any way to set a Windows laptop to slowly scroll automatically? I have co-incidentally taken this week as annual leave and have a hunneranwun things I should be doing but my right forefinger seems to be glued to the down arrow.

Thanks.

Press in the wheel on your mouse and move it slightly up or down depending on which direction you want, the more you move it the faster it will go.

Although this does make me swivel eyed 😁

I haven't been able to find a link to the underlying article on the Daily Mail website.

Sorry if I have crossed, it’s inset to a Myles article.

I suppose it's still possible that Fife could concede defeat (which would be a shame as I really want to hear NC's cross of KS!).

But would Upton? And how could JR advise both?

That’s very odd! The X post has a picture that looks like it’s taken from the actual Mail. Maybe we’d better treat it with caution 😬.

Pete is poised and ready

Pete needs to be careful, a plunger is not the way to tackle a blocked toilet as he may well end up covered in backwash.

A snake's the way to go

This is more than ‘a break’. What is going on?

I believe she said she didn’t read the letter and it didn’t affect her judgement or process. So, after.

Edited

She did know of the existence & content of the letter so presumably was trying to get Sandie back to work to forestall an Employment Tribunal.

The press reported that it's a Case Management Meeting, without witnesses.

It could be that one or both sides is requesting an Order, and that will need to be discussed and decided by the judge

I think we're heading for an early lunch.

If this carries on much longer, I might be heading for a liquid one.

Probably the Scottish Mail?

A trouser snake? I think implying Pete owns such a thing is deeply upsetting.

That may be a fair inference on the Trust as an organization, but I don’t think that’s a fair inference on her personally, unless MG’s letter was addressed to her directly. She may simply have been assigned the task that morning, and her personal motivation was to carry out the task she’d been given in a competent manner.

Appalonia · 22/07/2025 12:09

They're gonna end up breaking for lunch soon, aren't they...?!

Datun · 22/07/2025 12:09

If they're trying to reach an agreement, it's taking a while.

So I'm guessing there's a lot of disagreement, if that's what they're doing.

But if it were in the bundle it would be part of the consideration. SP was cross examined by JR who could have tried to discredit it. But as from what I can see it looks like hearsay, it would have little weight which is presumably why it wasn’t raised by JR as she didn’t want it to gain any.

Yes, that is want I meant - the newspaper article seemed to imply that it was part of the bundle.

I was wondering whether the judge ignores information in the bundle if it isn't referred to in court.

Probably the Scottish Mail?

The article is online but it doesn't seem to include the inset mini-article that was so eye-catching.

Say what you like about employment tribunals, but this one really has had a lot of drama.

Tried that 3 times, going to the loo twice and took a phone call and had a chat with the binman.

I'm running out of ideas to get this to start!
