Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I haven't been able to find a link to the underlying article on the Daily Mail website.

I looked as well as the wording seemed off and can't find it anywhere so I'm reserving judgement at the moment.

I have a twitter/X account, solely for my perusal of GC individuals because to have such views on my FB or IG accounts would render me pretty much friendless I fear; should I actually announce my GC views on either of those platforms. It's a sad world.

However, I absolutely agree that twitter/X is utterly toxic with regard to individuals personal vendettas and how they can, quite freely, slag others off in the most demeaning of ways. It's really appalling tbh.

i answered someone the other day about not attacking people's looks, they have enough batshit material to attack - and was roundly and soundly abused and then blocked.

Legal question: This seems to be taken from investigation notes from the tribunal paperwork, but I don't think it was mentioned in the cross examination.

What does the judge then do with the information?

Ignore it because it hasn't been used as part of a legal argument by SP's team? Ignore it because it isn't relevant to this case?

Evidence of DUs behaviour in past roles would have to be put to him in court. A newspaper article isn’t going to influence the panel.

That seems a bit unreasonable if there is no opportunity to the opposing side to challenge their statement and potentially undermine what they wrote.

As per my post, if a witness is not available to be cross examined, their evidence will carry less weight.

But if it were in the bundle it would be part of the consideration. SP was cross examined by JR who could have tried to discredit it. But as from what I can see it looks like hearsay, it would have little weight which is presumably why it wasn’t raised by JR as she didn’t want it to gain any.

Can someone advise me if there's any way to set a Windows laptop to slowly scroll automatically? I have co-incidentally taken this week as annual leave and have a hunneranwun things I should be doing but my right forefinger seems to be glued to the down arrow.
