NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Yes you can - I do it a lot if someone has used an old/irrelevant header and I want to be able to find the convo later. So I edit the subject before replying

Is there anywhere where DU has defined what he means by “unsafe”. As I woman I take “unsafe” to mean the possibility that someone will do me actual,physical harm if I find myself in their vicinity.

I would call it “uncomfortable” if I felt that someone had negative feelings about me, possibly expressed verbally, or by ignoring me. I don’t really know a word that describes how I would feel if someone simply walked past me without acknowledging me, “ignored” is the closest, but that isn’t really the same as feeling unsafe is it.

I wonder if this morning’s closed session was about the inadequate/late disclosure of the other side’s documents..?

Do you know, I rather think she can. The sheer arrogance and stupidity of KS is breathtaking. You'd have thought she'd have researched NC before all this wouldn't you?

That is not the header. That is the subject line. The header is the backend electronic info.

But as you can she is drawing KS to testify that the group of witnesses had discussions they shouldn’t have and those discussions were not disclosed. It’s not mechanical but demonstrating through the witnesses on testimony that she is unreliable at best and a liar at worst. This will be backed up by expert.

And typically, NC leaves that hanging and goes on to the topic of who said DU could used the female CR.

Bloody hell. Defense witness agreed these non disclosed emails shouldn't have been written, somehow none out of six thought there was a legal obligation to disclose or even checked, and yet somehow they are claiming they didn't collude. This is no longer cricket, we are well into match fixing territory...
