NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

If this happened it should have appeared in IX bundle

The implication is that the potential witness was approached recently and backed away out of fear of abuse from supporters of SP.

I suspect there isn’t a separate changing room for Drs and nurses. We don’t have separate ones.

I believe there is a consultants 'lounge' for want of a better term and that it may have a separate toilet. Elspeth Pitt explained that they change and leave their belongings there. It sounds cozy. I'm not surprised they did not invite a junior doctor to join them.

Asked why she thought the Christmas Eve incident was a hate incident. She said it was because she believed Dr Upton had experienced harassment and threatening behaviour.
They were unsure, at the time, if it met the criteria in the policy for a hate crime.

KS is suggesting that at least one witness who could speak up for DU won't because of the publicity surrounding the case, and part of the reason for their worry is that they're mixed-race. That's interesting.

Surely at that point of time there would not have been expectation of publicity/press involvement?

Also, given the amount of discussion around the case, bringing this up now risks that 'mixed race' person becoming vulnerable. Because although we don't know who was on those shifts around Christmas, people who were there might.
