NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Dr Searle says she was concerned for Dr Upton and when she heard about Dr Elspeth Pitt's email sharing details.
Dr Searle says she did not receive that email until Dec 29. And read it along with an email from Dr Upton, sent at 3.17am on Christmas Day.

KS - looked for Fife policy, wasn't one

Assumed right to use CR, before checking the law etc.

Should have looked harder or looked at the haldane ruling as she would have known that he had no right nor the expectation of the right to use the female changing facilities

Dr Searle says she was very concerned as she knew this would have been very upsetting for Dr Upton.
She said Ms Peggie telling Dr Upton that they were not a woman was likely harassment incident under NHS Fife's hate policy.

Dr. Upton was also using the changing room extremely early in his social "transition" and wearing scrubs.

Not really any different perceptually than a bloke in a pony tail.

(PS doesn't make a difference to me but fact worth being aware of for TRAs).
