NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

NHS Fife and Dr Beth Upton's lawyer, Jane Russell KC asks Dr Searle about her job and how long she's been working for NHS Fife.
She says she first met Dr Upton in August 2023, and she is Dr Upton's education and clinical supervisor.
She usually meet the student doctors when they first start, familiarise them with the department and emergency medicine.

Asked about her relationship with Sandie Peggie, Dr Searle says she has known the nurse since she started working there in 2014.
Asked if she knew before the hearings that Ms Peggie had gender critical views, Dr Searle says she did not.

Ms Russell asks Dr Searle when she became of Dr Upton's trans status.
She says she knew about it before they started as Dr Upton told her about it and was very open about it

That post claims KS was sworn in. She was sworn in once observers were admitted. You never swear a witness in twice. Observers were kept out of court because they weren't ready to start the public session.

So no acceptance of liability, no settling. On we go.

Nobody seems to have been 'aware of SP's GC views' so she obviously wasn't making a big deal about them in her workplace.

The panels may choose not to believe her, of course. If there’s evidence of a lot of gossip about SP floating around the department they may imagine it’s entirely implausible KS hadn’t heard it.

If they are, they're heading the wrong way (which would be par for the course).
