NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I remember in previous tribunals that in the case of a delay observers wouldn't be admitted but would be kept at the WFTCHTJ stage. After an hour they would be kicked out automatically.

I've been very impressed by the organisation of the remote viewing. It's been exemplary. I think Boswell was very scathing about it on the first day and called it carnage/a shambles/some such. Completely unjustified and I've been taking his views with a big pinch of salt ever since.

He's a bit of a loose cannon, usually useful, but can be wa a ay off. He misread CM, I think, whereas Wings was spot on.

ps 1 on signal to noise - I started a reply on p38 but couldnt post bcos it whizzed over 40. (it was about the amazing coincidence of there being two CM's with exactly the same details, except the Linkedin one has a recent MBA (masters in business admin)

I have a question about CLM for someone with a good memory. It sounds as though she tried to Do The Right Thing in getting SP back to work. But was she Doing The Right Thing before or after NHS Fife received a legal letter from Margaret Gribbon?

After. However she had no involvement before, so it appears that she was only brought in because of the solicitors letter and that's when nhs fife restarted the investigation with staff other than ks and Ed etc.
