NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #35

1000 replies

nauticant · 21/07/2025 14:55

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.
Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Maybe a request to add ED to the list of wrong-doers. There could be a Part 3, in which case we need emojis for shock, despair, laughter and ‘you have to be effing joking’

JR - msgs between you and colleague, 'Trans doctor
was in CR this evening when I went in' Reply OMG 'PSML'. Pissing myself laughing. You and colleague were both laughing at DU.
SP - I believe that we were laughing about the colleague that I had previously asked if DU was going to use the female CR and thought he was winding
me up about it
JR - you were both mocking DU because trans
SP - no
JR - she said PMSL, you were both laughing about the TW in the CR
SP - no, we were more surprised that DU was using CR,
JR - you were making light of the fact that a TW was in CR,
SP - I was not making light of it
JR - you were, making jokes about it,
SP - Charlene knew that I wasn't happy about it, we weren't making light of it, it was about Chris who told us it would happen

The PMSL is from a colleague, not from Sandie, but makes sense to me in context. I infer from the emails that another colleague (Chris) had said earlier "[Dr Upton] will be sharing your changing room" - Sandie and colleague have said "you're having us on" or similar.

So when Dr Upton actually turned up in the women's changing room later that day, their text exchange is their reaction to that, having had the "no way, you're having us on!!" conversation earlier that day.

That's how I read it. The PMSL could be either of them, but it's a major stretch to say it's mocking DU trans status. "OMG PMSL" seems far more likely to be response to Chris telling them this would happen and them previously not believing it.

TBH, if the cross examination of a witness is going to be a blood sport, which that of KS appears likely to be given the unredeemable awfulness of those emails, I'd almost rather it took place out of sight.

After her horrendous behaviour she deserves everything NC can do to show the world what an awful bully she is.

You'd think someone at NHS Fife would have checked what they have on their web pages.

No, I really wouldn't!

Haha, yes, good point - I don't know what I was thinking!!

KS arriving in court with a stunning & brave smile for the photographer. (my photos are usually delayed, but see @iain_masterton on twitter, steering the tribunal press interest with photography in a way Fife Health Board cannot).

This New York Times article about the permissibility of supporting Trump and how you should deal with relatives who do is unintentionally hilarious and went viral:

https://archive.ph/UJvqJ

Trump is actually very popular in the US but the mainstream media won't report it. The economy is great, energy is cheap, low inflation, hiring is up, illegals deported, girls' sports single-sex only. The govt made a surplus over tariffs. And the President is supported by a large percentage of black and Hispanic voters.
I think it's a lingering left prejudice to dislike Trump. Go to x to get different news.

Every time someone says sex is a spectrum and nebulous and too complicated to understand and whatnot, I always think how embarrassingly shite in bed they must be. Do they even know what they're trying to achieve? Do they just strip off, stare at their partner and start putting fingers in ears or something like they're trying to work out a circuit on a trial and error basis?

Grin I think it's more likely that they're raging hypocrites and in private they know exactly what they're looking at and what to do with their own and someone else's body.

All NC has to do is get her to repeat some of the things she said in the emails, NC doesn't even have to raise her voice - Operation Let KS Speak.

ThatDaringMintCritic · 22/07/2025 10:32

That photo won't look good with the anticipated headlines coming KS's way.

I know. I think I've found the point at which squeamishness starts to kick in. It's visceral, not rational.

I didn't manage to get access this time (applied too late) but have they improved the previous tech setup where any audience member could turn on their mic and camera and proceed to dry their hair?

Yes. Observers can't join the waiting room unless they have switched off the camera and mic in their settings. Everyone has to enter using the name given in their application, so if anyone were to switch their mic back on again they could be identified and thrown out immediately (and potentially find themselves in contempt of court)

Thanks - it's nice to have a face to put to a name. I'm not watching live, unfortunately.

BettyBooper · 22/07/2025 10:34

TT is also tweeting another case today, in case people are interested.

'Kenny McBride is in court today to appeal the outcome of claim of unfair dismissal. Tribunal Tweets has permission to live tweet the proceedings. It is expected to begin at 2 pm today.'

Is that the same Charlotte?

Charlotte Myles whose profile on LinkedIn says Service Manager at NHS Fife got a BSc and an MSc at Manchester Met and an MBA at Wrexham University.

Apparently not. Someone else posted the Instagram link yesterday. It's odd that they both have the same name & have spent 10 years working in the NHS.
I took a look at the LinkedIn profile & I am impressed to see that she spent six years working as an HCA in A&E. She has had some other interesting roles too.

From the same page as the offensive "intersex definition", here's their definition of Transgender (my selected highlights, full definition in image)

https://archive.ph/706yG#selection-613.0-713.42

"What does Transgender mean?
This is a gender identity and/or gender expression.
This can mean someone who identifies differently to what you might expect of the gender they were given at birth (gender identity).
For example: someone may have been registered as female at birth, but they identify as male.
This can also mean someone who dresses or acts differently (gender expression) to what you might expect of the gender they were given at birth.
If you do identify as the gender you were given at birth then you are known as cisgender or cisgendered.
Being transgender has nothing to do with who you find attractive.
You can be transgender and straight (attracted to the same gender), or gay, or lesbian, or queer, or many other identities.
Trans or Trans is a short way of saying transsexual or* transgender.
Transgender is not the same as transsexual.
The word transsexual is not generally used by the transgender community.
It is best to ask what term a person uses."

This can also mean someone who dresses or acts differently (gender expression) to what you might expect of the gender they were given at birth - hey I think we all might fall under their definition, policy protection ahoy! (sorry, forgot, their wasn't a policy - but everyone else was doing it)

Interesting that the example they give is FtM rather than MtF.

According to her Green Party election leaflet CM is from Wigan in Lancashire & went to university in Leeds.

Interesting. That's not a Wigan accent I heard yesterday. I thought definitely Yorkshire and possibly Leeds.

Dammit you're right - by this definition I could be transgender!!
It's interesting it distinguishes between transgender and transsexual, which, given the waffliness of the term 'gender', means that 'transgender' can be anything you want it to be..
