After all of the recent cases I wonder if the trust will just concede? It would probably be cheaper and create less press if they simply held their hands up and let the judge decide what compensation is due?

Is it only up to them though? If the Nurses don't want to settle I assume they don't have to?

I believe that if they refuse to accept a settlement offer, go to court and win but are awarded less than they were offered to settle, they are liable for all costs, which can easily exceed the award and be ruinous, although it does get important legal rulings and precedents set.

This is where JKR's fund may come in useful...

The nurses don't have to accept a settlement offer, no. But that's not the only way for the NHS trust to end it. They can offer no defence (essentially plead guilty).

That avoids all the days in court and the publicity for the witnesses. It goes straight to a panel decision based on the bundle.

Just read on X that the NMC have had four complaints against the nurses and are investigating them. I firmly believe that people have the right to complain and it should be taken seriously and investigated. However, in this case I hope the NMC find no case to answer.

Now I wonder who could possibly have made those complaints, someone and his little cohort who threatened to make a Citizen's Arrest on Naomi Cunningham and a Judge perchance?

The NMC is going through reform if its processes. However, from various reports it is still a remarkably skewed witch hunt at times.
