Unfortunately the default for employment tribunals is simply to make good any financial losses. If you're lucky, and the other side had been particularly bad, they may award (usually partial) court costs.

Punitive damages are possible, but even rarer than an NHS HR department telling a transwoman to use the men's facilities.

From what @KnottyAuty and @TwoLoonsAndASprout have said about the NHS policy audits, this is Darlington HR implementation of what is effectively standard NHS HR policy.
That said, I am minded that the surgical suite scheduling was intentional and is testament to punitive motivation.

Unfortunately it is not just Karen's trust that has this policy of withdrawing treatment from any women who object to a male in a single sex ward. They are all operating this policy but the only way you know is by Freedom of Information search - appallingly secretive. The attach image is a screenshot from a London NHS Trust policy:

This has made me so angry again.
I was that nurse, that had distressed patients coming to me because there was a trans male on the ward. My response was similar to the one deemed 'not appropriate' but I wasn't going to lie. I refused to gaslight these women.

We were also supposed to say there are no men on the ward and LIE to our patients.
These women had ears and eyes and they knew damn well they were men, they'd exposed their dick FFS. And I was suppose to say 'oh no, you are mistaken, only ladies here'.

'The nurse should address any anxiety the patient has and address any underlying beliefs the patient has that may be unfounded'

Unfounded?? The belief that the person wandering around the ward with his penis exposed is a man? Unfounded??

And then check if the poor man is ok? He might be terribly distressed by being called a man by some hateful bigot in the next bed.

No woman should have to go through any of this. The NHS makes me sick to my stomach and needs to be held accountable for all the damage and pain they have caused.

I’m incredulous. HOW did the views of senior management/HR become so warped that they couldn’t see what was so obviously smacking them in the face? Rose was a man and had no place in single sex space at any point. When the vulnerability and concerns of Karen (and others) were expressed he should have been removed forthwith. I
Im sure these concerns were expressed to ‘Rose’. The fact that he wanted to persist under that justification says everything we need to know about him.
The NHS lost its mind.

I can’t be the only one who read the Mail article and was unsettled to read ‘Rose’ works in theatre with sedated and unconscious patients.

I feel frightened knowing that an NHS Trust has not only allowed a male with known predatory behaviours to work with incapacitated female patients - but that the Trust had enabled and supported this male to be in those situations.

It is so obvious that this male was getting sexual kicks from being involved in intimate care and procedures on female patients.

When you consent to surgery, you are trusting that the staff will keep you safe and treat you with dignity and respect.

Clearly you can't trust them to protect you after all.

So you are saying that something unpleasant doesn’t matter because it might only happen to a few women. And some transpeople are nice, and misunderstood.
Also, we are nasty bigots for not wanting that unpleasant thing to happen to anyone and trans people are the most marginalised and oppressed people around, hence suicidal.
