NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

The hearing is being live tweeted by https://x.com/tribunaltweets and there's additional information here: https://tribunaltweets.substack.com/p/peggie-vs-fife-health-board-and-dr. @CheekySnake IANAL but as far as I can work out, he cannot apply for a GRC yet because of the necessity of 'living as a woman' for two years. I assume a GMC registration in female name/new number can be used as evidence when the time comes ...

So he can register with GMC as female 'gender' without GRC?
GMC just take his word at face value?

J being unreasonable surely; if NC is supposed to cross examine Upton tomorrow with these documents, she needs to have a reasonable way to refer to them. NC has the patience of a saint.

SelfPortraitWithHagstone · 11/02/2025 14:53

I mean, possibly I'm being thick, but couldn't you just set up more than one camera/ computer and run several independent, concurrent Teams meetings at once?

Argh this is so frustrating - especially given that the media are such a shitshow.

Has the chair made completely clear what is happening with public access? Like, in a definitive way?

I don't believe he has, it was made clear that the media will be given access and he may revisit limited numbers of public access as the tribunal progresses. So much so open justice and transparency, but brilliant so many people are logging in and this case has piqued interest.

NC has said she's happy to finish DUs evidence.

Keeping a witness under oath for months is not what anyone wants.

How many supplementary bundles have now been submitted?

I might start a petition so we can have a "roving public inquiry" as I think we are long overdue one!

I was thinking last night that I may have reached the point that I wouldn't mind if the BBC was de-funded. This free-at-the-point-of-delivery service has been complicit in this scandal

Bundle issues

EauCaledonia · 11/02/2025 14:55

rebmacesrevda · 11/02/2025 14:51

NC wants a non-repetitive bundle by 5pm

We can only hope that RMW isn't on the bundle team.

That seems to be what happens. you can also change the sex marker on your passport, driving licence, and NHS registration just by asking.

You cannot, however, have the sex marker changed on a birth certificate if the registrar incorrectly sexes your 5 day old baby.

exwhyzed · 11/02/2025 14:55

Did JR just slip up re her knowledge of the undisclosed emails? States they are mostly just forwarded emails of the same info to others and we're not felt to be relevant.

NC 'it's important to establish who knew what when'

WallaceinAnderland · 11/02/2025 14:55

Those watching, do we need to request a new code every day? The one I had yesterday was invalid.

SauvignonBlanche · 11/02/2025 14:55

BU reminded that is still under oath

I hope they include TT as media.

The judge did say 'media and Tribunal.Tweets'.

Iamnotalemming · 11/02/2025 14:56

Another frustrating day in court.

I'm out all day tomorrow so won't be able to join. Thanks in advance to those who are and will be commenting.

Peregrina · 11/02/2025 14:39

But NC is asking that it's adjourned for the rest of the day

I'm glad because I should be working!

Lol. Women's rights is more important than working!

Shetlands · 11/02/2025 14:56

Listen up MNetters - you've been let out early so no excuses for not catching up with all that overdue work, cleaning, shopping, DIY, studying etc in the precious hours between now and 9.30am tomorrow. Let's GO... 🏃💼✍🛠

Yes but the latter only benefits babies and their parents and not creepy, coercively controlling men so OBVIOUSLY that can't be allowed whilst simultaneously the demands of the coercively controlling men are met unquestioningly.

I'm so sad this isn't a fever dream.
