NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #12

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to continue for 2 weeks although at the start of the second week getting everything done in this time period was looking less certain. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

JR needs to make her mind up - is it
a) she's seen the non-disclosed documents and decided they weren't relevant and didn't disclose them to tribunal ?
or is it
b) there was a mistake and DU didn't know they were meant to disclose stuff on private phone so nobody saw the messages until today?

Because right now JR is just making herself look stupid

Can someone who has given evidence be recalled? For example to address something in a document that wasn't disclosed at the time they gave evidence?

How wonderful the public access system was in danger of crashing. I for one was and am pissed off but look at the bigger picture - more and more people engaging. Just brilliant.

Given the stink kicked up over nhs fife withholding stuff last week, to find out that Upton has tried to hide his own emails this week, combined with the fact that he's got no proper information about any of his patient care complaints, just beggars belief.

  • the system is at risk of crashing due to number of observers
  • access will be restricted to the press and TT
  • they are working to find a solution so everyone can access remotely and so the situation may chance

Is there some mechanism for getting disclosure if respondents have failed to comply. Can they send in the police, for example? Or some kind crack judicial email team? If they just refuse to comply, which is illegal, there must be some legal mechanism for forcing it.

You can make an application for specific disclosure which specifies the documents you want access to, and then a judge will make an order saying 'by this date and time these documents will be handed over'. If a party still refuses to comply with a specific disclosure order there can be costs consequences, a strike out of their case, or even contempt in extreme cases.

@CheekySnake IANAL but as far as I can work out, he cannot apply for a GRC yet because of the necessity of 'living as a woman' for two years. I assume a GMC registration in female name/new number can be used as evidence when the time comes ...

There seemed to be a query from the judge if JR would need to re-examine

NC asking for the judge to ask for a bundle to given to her by 5pm today and asks that the respondents don't fuck it up (my paraphrase).

How can DU have redacted information yet we can be sure that he hasn't also 'edited' some of the metadata?? I wouldn't trust DU as far as I could throw him.
Also - pages of hurty feelings!! What were the BMA advising DU??

These kinds of delays and requirements for additional hearing days can be ruinously expensive for the parties and it's largely down to R's balls up with disclosure. I do hope that J takes this into account on costs later.
