NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #8

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

NC - let's assume it's the women's CR, he's not supposed to be there

BU - a woman has communicated she feels uncoomfortable. I'd understand why she'd feel menaced. But ... I agree it would be unusual behaviour on Pete's part. I don't feel getting changed to be in herenetly sexual nor menacing. Pete's intent is important, his voice, his proximity, his knowledge. That doesn't exclude the other person feeling a certain way. But to cahractersise as menacing implies an intention to menace. If his intention is to menace it's menacing, but it coudl equally be interpreted as menaching.

NC - Pete's presence alone is enough to create humiliating environment for the nurse

BU - not necessarily . What if Pete's the repair person, a plumber, coming to fix a blocked toilet, maybe he's made a mistkae, these are two hypothetical scenarios

In a women’s changing room, any man is inherently sexual and menacing. Frankly.

BU - if he's confrotned with a person saying I'm not fussed, I'm going to get changed, closing door, starting to undress isn't 'just being there'. So is it Pete's behaviour and dismissal of woman's distress, or just his presence? Scenario keeps changing. Don't understand what I'm being asked.

In order to avoid admitting that women are reasonable to be intimidated by a man in the changing rooms, he's trying to argue it would be fine for an actual manity man (A cis man assigned male at birth, who identifies as a man' in his words) to walk into the women's and change in the women's as long he didn't intend to be menacing.

BU - don't think periods are inherently sexual. If they were discusisng her genitals, being crude, could be sexual. I don't think the menstrual cycle is inherently sexual.

This is coming across as how women would see quite a lot of this as intimidating. When the man could be seeing it as not intimidating.

I have to say, much as I dislike what DU has done, he is maintaining a reasonable demeanour under these questions.

at my old gym - if a male tradeperson had to come and fix something in the ladies, they wouls swap the men & womens chaning rooms over until the worls was done.

The female only space was vigoriously defended. In the rare event a man had to come in, a woman would first come and let all the women in the changing room know what was about to happen.

All completely unnecessary in DrU's world
