NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #8

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

In a women’s changing room, any man is inherently sexual and menacing. Frankly.

Intent to menace or not can't be interpreted, he just flipping admitted it.

BU - if he's confrotned with a person saying I'm not fussed, I'm going to get changed, closing door, starting to undress isn't 'just being there'. So is it Pete's behaviour and dismissal of woman's distress, or just his presence? Scenario keeps changing. Don't understand what I'm being asked.

Mine too. I imagine DU as a awkward, autistic man. I worked with a few and they do tend to be a bit 'know it all'.

In order to avoid admitting that women are reasonable to be intimidated by a man in the changing rooms, he's trying to argue it would be fine for an actual manity man (A cis man assigned male at birth, who identifies as a man' in his words) to walk into the women's and change in the women's as long he didn't intend to be menacing.

And if Pete says I'm a woman then it's all'ok. But before that we as women have to examine Pete's behaviour and his words etc before deciding if a big man appearing while we are semi naked is a problem

This is coming across as how women would see quite a lot of this as intimidating. When the man could be seeing it as not intimidating.

I have to say, much as I dislike what DU has done, he is maintaining a reasonable demeanour under these questions.

I was about to log off because I'm getting no work done but at last we've reached the point where he gets to explain why he's different so will hang about.

He doesn't like that he doesn't know where the conversation will go and therefore can't control it.

at my old gym - if a male tradeperson had to come and fix something in the ladies, they wouls swap the men & womens chaning rooms over until the worls was done.

The female only space was vigoriously defended. In the rare event a man had to come in, a woman would first come and let all the women in the changing room know what was about to happen.
