NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Unbelievable

If they are discussing a settlement, we don't know (and probably will never know) whether it is because DU has refused to be cross examined or NHS Fife has decided to fold. If it is the latter, DU will have little choice but to accept. I doubt DU could afford to fight on without NHS Fife's support.

DU has been perpetually late.......this is not acceptable. Everyone else has been in place and waiting for over a hour. There is no good reason for just one person to demand so much time, attention and resources.

Sorry if I missed it, but does the fact JR is representing both NHS Fife and Dr Upton mean that the NHS are paying his costs? Would thete have been a bill for working for each defendant, and more usually they would have had separate representation?
Who pays his costs / her compensation due on account of his actions if he loses? There would be differing costs for that too wouldn't there?

I think how it's all carved up and who is responsible for paying what is ultimately a matter for the respondents to decide between themselves. They can have regard to principles of liability but ultimately if Fife agree to indemnify Upton, even if they don't have to, that's a matter for them.
But it's not just about the money. Any requirement for an apology or statement will feed into decisions on how the financial side is carved up.

According to Michael Foran who is actually at the tribunal there should be two security guards but only one has turned up. They're waiting for another to arrive.

@LondonLawyer seems that there’s a socking great clash between this and the long enshrined 1992 H&S regs requiring male and female facilities. I wonder if this has been tested specifically in a court. Even worse as it seems that you can just say a few words declaring intention to transition and completely trash important health, safety and welfare at work that has been in place for decades.

If the tribunal finds against Dr Upton, wouldn't the NHS have to sack him and report him to his regulatory body? So they've really stuck their neck out.
Because surely they couldn't continue to employ someone with such findings against them?
Although I agree with PP, they may well see it as worth it just to get the matter sorted out for them.
