NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

DU has been perpetually late.......this is not acceptable. Everyone else has been in place and waiting for over a hour. There is no good reason for just one person to demand so much time, attention and resources.

Wasn't aware of that. Courts usually allow a certain amount of leeway but there are possible penalties, including the defence case being dismissed and SP being given judgement by default. However, if reports are correct, it is not DU's lateness holding up proceedings.

It will depend on when a security guard turns up. If they are unable to open proceedings with only one and this is a no exceptions rule then they won't start until they have 2. I've worked at places like this and something like this can result in a lost day.

He did turn up late but seems he has now demanded extra security. How much security was Peggie given?

It doesn't look like they are negotiating a settlement. But yes, such a provision could be part of any settlement.

No, that does not appear to be what has happened. The court usually has two security guards but only one has turned up. Saying he has demanded extra security is just making things up. There is no evidence that he has demanded anything. As I understand it, the court just wants the same level of security that has been in place throughout the hearing up to today.

Is he demanding extra security? MF's thread reads otherwise, it's standard to have 2, but there's only one at the moment and they're waiting for no. 2.

It could be. But if they offer a money settlement more than the court would award then the other side cannot afford to refuse it because of costs. And in that case Fife don't have to agree to anything or, indeed, even admit liability or fault.

Not extra. One of the two security guards meant to be on duty didn't turn up and they're waiting for a replacement to arrive.
