NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #5

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on 6 February.

Might the delay be related to NC still waiting on the disclosure of the emails?

Having done tribunal work, whilst it is intensely frustrating, the delayed start won't be because the panel are drinking tea and chatting. There will be something being sorted behind the scenes. That might be a legal issue (e.g. the lawyers arguing over whether a piece of evidence is admissable - letting them come to agreement if they can is much quicker than the panel having to hear submissions and make a decision). Or something practical. Someone not having arrived as expected would be an example of that, but it could equally be that the electrics in the panel room have failed, or the roof has started actively leaking.

Honestly, given the numbers of people and high emotions involved it always amazes me that it isn't even more chaotic.

It’s brilliant that this is coming out into the open. Working in an office for a mid size “pronouns optional” company this wouldn’t even have been discussed a year ago but this morning there is a startling lack of meetings taking place and a whole lot of tribunal tweets scrolling and theories are being discussed for the delay. Sandie is an absolute Shero.

The strength of Sandie is awe inspiring, given her last 18months and the recent loss of her dad.

I am enraged that her strength holding up against this situation will be used to suggest she wasn’t hurt by having a bloke intimidate her out of her rightful place.

That's what I've been doing all week and it worked fine. Until today. The most important day!

Hmm what's the likelihood of a closed session

If it's the case that DU is unable to attend due to a mental health crisis, some will understand this to be symptomatic of the ills of the transphobia he endured at the hands of of SP and is now enduring through media and social media attention. Others will regard it as evidence of his mental health issues and indicative of significant potential for him having misconstrued SP's actions.

From earlier posts, it sounds like the panel will simply regard it as diminishing the weight of the evidence he presented as it wasn't able to be cross examined.

To be fair, patients waiting to be seen in A&E Kirkcaldy will be waiting much longer
