NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #3

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Panel will ask any qs then possibly some reexamination by NC. Then onto next witness.

We always say it’s a bad sign of the judge isn’t writing when you’re cross-examining or making submissions - they don’t think the evidence is relevant! Which to be fair, it doesn’t sound like it is. Nice they gave Maya a platform to do a whistle stop tour of the whole illogical ideology though.

I wish we'd got onto furries. Oh well, can't have everything.

The general rule in civil cases is that you can only ask the court to reject the evidence of a witness on a material point if you have challenged that evidence by cross examination. JR therefore has to cross examine MF unless she wants the court to accept her witness statement in full.

Every time one of these cases comes forward, each one of the judges and everyone else in the room is being educated on the subject for the first time.
Very embarrassing for professional barristers to not know their stuff.
