Excellent news.

And Sturgeon has really shot herself in the foot here (again). Because if she really thinks 'trans women are women', why is she not allowing this 'woman' to go to a female prison?

So therefore she knows this person is not a woman.

So therefore she is being transphobic...

Was reading an excellent Twitter feed this morning by @mbmpolicy, which highlighted how the decision making process during the development of the SPS’s Gender Identity & Gender Reassignment Policy “failed entirely to consider the impact of its policy on female prisoners and staff, focusing only on the needs of transgender prisoners.”

Also, the Equality Impacts Assessment SPS conducted to ensure the new policy upheld the Equality Act, reveals no female prisoners, no prison staff and no woman’s rights groups were consulted during the policy making process. But the following groups were consulted:

  • Trans people in prison and in the community
  • SPS Mangers and Officers (including E& D Managers)
  • Trade Union
  • Government Agencies (including Scottish Government and English Prison Service)
  • SPS Legal Branch
  • Scottish Transgender Alliance
  • Capability Scotland
  • Stonewall Scotland

Then whilst on Twitter (again! 🙈) I saw a post saying a senior prison official convicted of child pornography was involved in the the SPS policy.

So of course being the She of Sleuthing that I am (love that and have never come across it before! courtesy of @ResisterRex 😊), I looked into the people involved in making their policy.
And lo and behold - Gordon Pike is one of the 8 people listed within the list Equality Impact Assessment.

Can this get any worse, I honestly don’t know.

The amount of politicians, journalists and all-round fuckwits coming out with, 'Well, in this one extreme instance it isn't right to send this rapist to a women's prison' is infuriating. The uncomplicated system whereby we had sex-separated facilities in some circumstances worked pretty well. This case-by-case scenario is hypocritical, unworkable, and leaves women's safety down to arbitrary decision making rather than a guarantee.

By what criteria are they deciding that Adam Graham is faking it but other men are not? Do they even think he is faking it, or do they just think this particular 'woman' is uniquely dangerous? If that is the case, then what is it about Graham that is so much worse than the many other cases of trans sex offenders and violent criminals? Do they think a woman will be happy sharing a cell or showering in front of a man who has been imprisoned for fraud? Right now it looks like a bunch of hypocrites have realised that the photos of Graham are so ludicrous and the political timing of this is so inexpedient that they are having to abandon even their own twisted logic.

In the unlikely event that Graham persists with his charade after his release, what happens then? Will he be able to identify his way into a women's hostel, or locker rooms and toilets? What happens to this case-by-case testing of trans authenticity then? How does it work?

Exactly. I'm an atheist but I have a lot more respect for religious believers compared to TRAs. Religious believers could conceivably be right - we can't know. But we do know that gender ideology is internally inconsistent and disproved by facts.

Well my main view is that your friend should stay the right side of the law and it won't be an issue.

Of course that's not what you are asking. Well your friend if they must break the law and end up in prison it should be the Male estate. We could say, effeminate men, gay men, fragile men should also use the female estate, but they dont. What's the difference?

Women are not default human shields, if my daughter was in prison at the same time, she should be allowed to have as much dignity as any other woman. We all know the Male gaze is or can be fucking awful and predatory and frightening.

Even if we are not at risk of rape , plenty of sexual assaults happen without the mighty penis.

Simple, just send in male wardens and tell them to identify as women at the time. Same thing isn't it?

@nilsmousehammer - you are right. The Scottish Government will face a judicial review on this. Because however sensible it is now move this man into a male prison, it means that other decisions not to do so, and the guidance are in question. Sturgeon's intervention also problematic.

A basket case government- full of stupid people who seem to think law is whatever you say it is on the day. The SNP leadership are idiotic. They are actually worse that their Westminster equivalents who at least know how to present a u turn.

That SPS Equality Impact Assessment is a shocker.

The form refers to gender not sex (so not the protected characteristic) and anyway the box isn't even ticked.

Which equality groups will be affected by the new or revised policy/practice?
= Age, gender identity, sexual orientation - ticked.
= Gender - not ticked.

The we have
Eliminate discrimination, harassment and victimisation?
= It will eliminate discrimination, harassment and victimisation- ticked.
= It will make discrimination, harassment and victimisation worse - not ticked.

Apprenently it's also going to foster good relations between people who share a protected characteristic and those who do not. How's that going Nicola?
